Avary was driving one of Mr. ? Campbell's lumber trucks had a puncture in front of the school house. He jacked up the wheel to fix it. The jack slipped and the jar broke allowing the load of lumber to fall on some children that were standing near by, killing Robert Lindsey, the seven year old son of Mr. and Mrs. Lewis Lindsey and seriously injuring the other little boy, the son of Mr. Bud Wheeler.
