Probate Court-vertical File Photo can be seen at: http://www.usgwarchives.net/ga/newton/photos/documents/adminstr24252ph.gif Image file size: 243.3 Kb Administrator’s Bond-Nancy Fincher-March 3, 1834-[estate of John Fincher] On March 3, 1834, Nancy Fincher and John Webb posted a $4000.00 bond to secure the administration of her husband’s estate. She is noted thereon as: “Nancy Fincher administratrix with the will annexed”. Her husband John Fincher’s will was dated October 13, 1832, and was recorded in Will Book 3, pp. 60-61 on July 3, 1833. Two of six subscribing witnesses to the will, John Clark and Prior Reeves, had sworn to its veracity on July 1, 1833. On September 9, 1833, Pleasant Evans-a third witness, was also sworn as shown on an original copy of the will-a legal sized folding portfolio-that is included with this bond document-and others in a vertical file folder in the Newton County Probate Court office. There is one major difference between the original copy and the court clerk’s copy; son Christopher Fincher was omitted in the latter one, in regard to distributions occurring after the death or remarriage of the widow [Nancy]. This bond document, the original will copy, and a few other “loose” court papers were sorted and organized by John I. Bruno, while compiling estate records for his book-two volumes copyrighted in 1996. I don’t know whether Mr. Bruno worked in the extremely cramped Probate Court vault of the old Courthouse, but genealogists will be forever grateful for his efforts. In Newton Co. on September 19, 1831, John Fincher bought 100-¼ acres-the northern half-[101-¼?]-of lot #101/9th district from John Ellis for $275.00-as recorded in Book D, pg. 501. In Jasper County in Deed Book D, pp. 688-690, ten of the eleven children who were named in John Fincher’s will(or husbands)are named in a deed dated January 2, 1850, in selling the whole of this lot-[202-½ acres]-to William G. Dunn for $810.00. A copy of the 1831 Newton Co. deed is included in these pages. On December 12, 1850, William G. Dunn sold the northern half of the lot to Leonard C. Fincher for $430.00. There is no mention of an estate in these deeds, but it is very likely that the Fincher heirs were dividing family property shortly after Nancy’s death. Another Jasper Co. deed- dated January 2, 1850(Book D, pg. 514)shows the sale of another parcel-by the same named “heirs”, 153 & 2/10 acres of lot #100/9D. to John C. Waters for $1200.00. These children-the Fincher “heirs”, are listed in the same order in the 1832 will and on the 1850 deeds, likely in the order of their births. It is not known if Nancy was the mother of all. Below they are listed in that order-[or with husbands]-as indicated in the documents, or as found in other records. The missing child in the deeds-James Fincher-[between Lucinda and John J.]-is my ancestor. As yet I have found no evidence of his death, or who he married, but his children were raised by their uncle John J. Fincher. Margaret J. and John L. Fincher were listed separately from John’s children on his 1850 & 1860 Jasper Co. censuses. I have not found any records of a guardianship. In February 1862, John Lumpkin Fincher married Arra Ann Dearing in Jasper Co., then moved to Butts Co. in 1863, when his father-in-law Thomas J. Dearing bought 182-1/2 acres of Dr. James H. Bryans’ plantation(#217/8D.). After Arra’s death, John L. Fincher married her sister, Sarah Adaline in Butts Co. in May 1864. John was involved with several businesses near his home.
