I, Jordan Baker of the County of Newton and State of Georgia being of sound disposing mind and memory and being desirous of disposing of my property in my own way - do hereby utter publish and disclose the following to be my last will and testament - hereby revoking all other wills made by me heretofore at any time. Item the first - It is my will and direction that all my just debts be paid and as early after my death as it can be conveniently done. Item the second - I do hereby give and bequeath to my wife all and singular the property of every nature and kind whatsoever brought by her into the coverture and this lieu of dower in any of my lands. Item the third - It is my will and desire that after my death my executors proceed as early as practicable to sell all my real estate lying and being in Newton County and in other places if any, also all my personal estate of every nature and kind whasoever except my negro property, and the funds arising from such sale to be equally divided share and share alike each one accounting for any advancement made, between the following persons, viz Daniel Newman Baker my son, Jesse L. Baker my son, Thomas Baker my son, Jesse L. Baker and Daniel N. Baker in trust for my son Wiley Baker and his children Jesse L. Baker and Daniel N. Baker in trust for Charles my son Zadock C. Baker and his children. To my son in law Charles Hutson, and to Jesse L. Baker and Daniel N. Baker in trust for the sole and separate use and benefit of my daughter Elizabeth Hutson and her children, to my daughter Fanny McLendon and her heirs to my daughter Zipporah Goss and her heirs and to my daughter Alis Bagby and her heirs - making in all ten shares to which the same is subject to division. Item the fourth - it is my will and desire that my executors procure three persons to be appointed by the Court and ordinary of Newton County, to divide my negro property into ten shares and the same after such division to be given to the persons provided for and attended to in the third and preceeding item of this my will, and the shares inteded for my daughter Elizabeth Hutson and my sons Wiley and Zadock be held by the saida Jesse L. Baker and Daniel N. Baker in trust respectively for them. Item the fifth - It is my will and desire that all other property evidences of debt and not herein and before disposed of by my executors turned over to the ten persons referens [sic] to in the third item and upon the terms and manner therein provided for. Item the sixth - It is my will and desire that my wife have no other share or interest whatsoever in my estate either real or personal or mixed other than given to her in the second item of this will. Item the seventh - It is intended that this last will and testament is to embrace any and all property owned and possessed by me at my death either not herein named or may result from future acquisitions or from the increase of any [blank space follows] Item the eighth - Having full faith and confidence in my sons Jesse L. Baker and Daniel N. Baker I do hereby appoint them executors of this my last will and testament - in witness whereof I have herewith set my hand and seal this the 22nd day of October Eighteen Hundred and forty seven Jordan Baker {SEAL} Witnesses: John Willianson John Harris Cary [illegible] Additional Comments: Since Jordan's first wife, Polly, died Oct. 10, 1843, four years before the date of this will, the disinherited wife may be the Sarah McGuire who married a Jordan Baker in Newton County on Sep. 22, 1844. On the other hand, she may not. Jordan's daughter Zipporah was first married at an unknown date and place to Hamilton Goss. Her second husband was Benjamin F. Sigman. The provision of the will dealing with the disposition of slaves is a shameful fact and must beincluded if the transcription is to be faithful to the original, but I am sorry their names are not included, which would possibly make the dcoument of use to their descendants.
