Will Book I, pp.60 & 61] Georgia} In the name of God Amen Newton County} I John Fincher of the State and County afore- said being weak in body but in perfect mind & disposing memory do make publish and declare this my last will and testa- ment in the following manner-to wit: First I will that all my just debts be paid Secondly I give & bequeath to my daughter Mary Lambeth one feather bed & stead & furniture one cow & calf & one sow & pigs which I have already delivered to her Thirdly I give & bequeath to my son Christopher Fincher one horse saddle & bridle cow & calf, one sow & pigs which I have delivered to him Fourthly I give & bequeath unto my daughter Margaret Pope one cow & calf one feather bed stead & furniture one sow & pigs Fifthly I give & bequeath to my beloved wife Nancy Fincher the residue of my property both real and personal during her natural life or widowhood for the purpose of raising and Educating my children and it is also my will & wish that as the balance of my children arrives at age or marries that they be paid in proportion to those already married and at the death of my wife or her intermarriage with any other, that the whole of my estate be divided in the following manner-to wit: I give and bequeath to my daughter Mary Lambert an equal part of my estate---I give and bequeath to my daughter Margaret Pope an equal part of my estate--- I give & bequeath to my daughter Lucinda Fincher an equal part of my estate---I give and bequeath to my son James Fincher an equal part of my estate---I give and bequeath unto my son John J Fincher an equal part of my estate----I give & bequeath unto my daughter Permelia Fincher an equal part of my estate--- I give & bequeath unto my son Leonard Fincher an equal part of my estate----I give and bequeath unto my daughter Nancy Fincher an equal part of my estate---I give and bequeath unto my daughter Isbeal Fincher an equal part of my estate----I give and bequeath unto [end of page 60, begin page 61] My daughter Elithy Ann Fincher an equal part of my estate----and in case my wife should marry I give & bequeath unto her an equal part of my estate, with my children. I do hereby constitute ordain and appoint my wife Nancy Fincher, John Clark, Prior Reeves & Pleasant Evans my lawful executors to this my last will & testament, hereby revolking all former wills by me made. Hopkins, who entered it into the register on July 3, 1833. Additional Comments: Additional Comments: An original copy of this will is filed in the Probate Court- along with an administrative bond by widow Nancy Fincher- and a few other items. These “loose papers” in manila folders were organized by John Bruno while compiling his(2)books on Newton County wills & estates. This copy differs only slightly from the clerk’s book entry. When it was submitted, a third witness attested to the document, and son Christopher Fincher was included, regarding estate divisions, following the death or remarriage of the widow-(omitted in the clerk’s copy). On September 18, 1849, L. C. Fincher made application for letters of administration-("with the will annexed")-in Jasper Co. on the "Estate of John Fincher dec'd"-[see a legal notice in the Milledgeville, "Federal Union"-Dec. 18, 1849]-found online on The Digital Library of Georgia-website. Though an estate is not mentioned, several deeds recorded in Jasper Co. in early 1850, show distributions of John Fincher’s estate, after the death of his widow Nancy Fincher. A copy of John Fincher’s only recorded Newton Co. deed was also recorded in Jasper Co. And, all of the children named in his will-or their spouses, are acounted for in the Jasper Co. deeds, except for his son, James Fincher. I descend through that missing man, James, whose son John Lumpkin Fincher settled in Butts Co., near land that his father-in-law, Thomas J. Dearing, purchased in 1863. John L. Fincher, and perhaps a sister, Margaret Fincher, were raised by their uncle John Jackson Fincher in Jasper Co.(as shown on 1850 & 1860 censuses).
