I Josep Livingston of Georgia, Newton County, do make and declare this my last will and Testament in manner and form following: First I resign my soul into the hands of Almighty God, hoping and believing in the resission of my sins by the merits and mediation of Jesus Christ, and my body I commit to the Earth to be buried at the discretion of my executors herein after named and all my worldly estate I Give and devise as follows: First I Give and d evise to my son Robert B Livingston all that lot whereon I now reside to have and to hold to my son R B Livingston his heirs and assigns forever also two Negroes a boy Ellis seventeen years of age one Girl named Huldy about sixteen years of age, also I Give to my son Joseph Livingston the sum of sixty five Dollars; and to my Daughter Elizabeth H Trimble the sum of sixty five dollars, also I Give to Robert B Livingston my shot gun. All remaining property of every description whatever, with the plantation, stock, household and kitchen furniture is to be and remain in the peaceble possession of my beloved wife Elizabeth Livingston in lieu of thirds or Dower during her natural Life; all the remaining property at that time of every description is to be equally divided between the undernamed heirs or their heirs or assigns share and share alike after payment of all Just debts William Livingston James Livingston Joseph Livingston; William B. Foreman; Heirs of the body of My Daughter Rutha Davis; and my Daughter Elizabeth H Trimble, I also appoint James Livingston Joseph Livingston and Robert Livingston my lawful executors, hereby revoking all former wills by me made In witness whereof I Joseph Livingston have hereunto set my hand and Seal this the 21st day of July in the yera of our Lord one thousand eight hundred and thirty eight and sixty second year of American Independence signed sealed published and declared by the above named Joseph Livingston to be his las will and testament in the presence of us who have hereunto subscribed our names as witnesses in the presence of the testator. Additional Comments: This is my great-great-great-great grandfather's will. I have been working on the Livingston genealogy and thought maybe some other family member might be interested in this will. I also have some marriage certificates. I have left the spelling and punctuation in the will just as it is on the copy I have.
