King State of Georgia} Newton County} In the name of God! Amen!! = I, Samuel A. King of the State & County aforesaid, being an invalid & believing that I may shortly depart this life, deem it right, both as respects myself & family, that I should make a disposition of the property with which a kind providence has blessed me. Do therefore make this my last will and testament and hereby revoking all others heretofore made my me. Item 1st = I desire that my body be buried in a decent & Christian-like manner suitable to my circumstances in life. My soul I trust shall return to rest with the God who gave it. Item 2nd = I desire & direct that my just debts be paid by my executors hereinafter named. Item 3rd = I desire & direct that my executor have placed over my grave a granite box tombstone over my grave with suitable inscription. Item 4th = I desire and direct that what money I have on hand be equally divided between my wife, Francis A, Martha L. and Augustus L. King-and my notes as they are collected to be equally divided as above named, also a life policy in the Southern Life Insurance, if ever collected, to be divided as the rest. Also to divide the household and stock farming utensils A.C. to suit the above named wife, daughter & son. I desire the heirs named not to sell the lands belonging to the estate, until financial matters will authorize the sale of such property & the proceeds equally divided between the above named heirs. Item 5th = I desire & direct that in the event my wife Francis A., Martha L. or Augustus L. King shall die, then the property shall return to those living. Item 6th I desire & direct that my grand child Jennie E. Daniel (only child of my daughter Fannie E. Daniel, deceased) when she is of lawful age have five hundred dollars to be held and paid to her out of my estate by my executors hereinafter named. Item 7th I hereby appoint & constitute my son Augustus L. King, Executor of my last will & testament. In item the 6th if my grandchild Jennie L. Daniel dies before she is of age the amount to be divided equally between my heirs living & named above. This Oct 20 1876 Samuel A. King Signed, sealed and subscribed by Saml A. King as his last will and testament in the presence of us who subscribed our names hereto, as witnesses in the presence of said testator (at his special request) and of each other. This Oct 20th 1876 Wm. Cowen J. A. King William Thompson Newton Court of Ordinary} November Term 1876} Personally appeared in open court J. A. King who being sworn deposes says that he saw Samuel A. King sign, seal, publish & declare the annexed paper as his last will and testament, while of sound, disposing mind & memory, that deponent subscribed the same as a witness, in presence of testator, at his special instance and request & in the presence of William Cowan & William Thompson, who also subscribed the same as witnesses in the presence of testator & of each other, that said will was executed freely & voluntarily by testator on the 20th day of October 1876.
