This file was contributed and copyrighted by: Carla Miles < milescng@juno.com> ================================================================================ June 2002 Newton County, Ga Record of Wills, Book 1, 1823-1851 Georgia Newton County Sarah Fielder of said County knowing that all have once to die being now of good health and sound mind and being possessed in my own right of a Negro Becca about Sixteen years of age and her child Nancy about two months old, do make this my last Will and Testament so far in regards the above named negroes and their increase only. First, I give and bequeath unto my granddaughter Sarah An Loyall, the two above named Negroes and their increase except the first born of the said Becca after this date. Provided however if my daughter Sarah An Loyall should hereafter have a child or children then the above named Negroes and their increase as above excepted are to be divided between my said Grandchild and her brother or sisters or brothers and sister as herein after expressed. Second, if the said Negro should hereafter have a child I do give and bequeath the first one born after this date unto my daughter Mariah Montgomery to be delivered to her so soon as the child can be weaned from its Mother. Thirdly, my desire & will is that said Negroes and their increase with the exception of the next born of the said Becca be divided between the children if more than ? of my said daughter Sarah An Loyall in the manner following to wit, When any of the said children arrive at the age of twenty one years or marry than there shall be an equal division of said Negroes unto as many different lots as there are children of said Negro said daughter, Sarah An then living and the one who is then twenty one years of age or marrys shall receive from my executor such equal portion or shear (share) as it may be entitled to, the remaining part or parts shall then be continued in the possession of my executor until the next child of my said daughter Sarah An arrives at the age of twenty one years or marrys at which time my desire is that there should be an other equal division of the Negroes retained from the first lot given off in the same manner as before and that said child shall receive its portion and so continue dividing the said Negroes equally until the youngest child of my said daughter arrives at the age of twenty one years or marrys. Which said child shall then receive the residue of said Negroes. Fourth, I do hereby nominate and appoint my worthy friend and son in law John Loyall to be my executor of this my last Will and Testament. That at the time thereof she was of sound disposing mind and memory, and that she did it freely without compulsion to the best of the knowledge of deponents, and that deponents signed the same as subscribing Witnesses and saw Reuben Phillips do so likewise.
