To wit. That each one above throws all their estate in to this joint interest as Common property of husband and wife So far as the use of said property is Concerned for the joint & mutual benefit and happiness of both are concerned, and they agree jointly that they will at their pleasure or Choice use all or so much of their income as they may feel necessary for their own enjoyment, & living in any way they may Choose and if they have any surplus over & above their wants as above at the death of either-We by then in that Case their Children on both sides Shall mutually divide Said Surplus or over plus of property made or Saved during their Connection-and it is expressly agreed on between these parties that all the estate of each of them with the income Shall be Subject to go to each of their own Children, or Subject to their parents own disposition of it, as they may Choose and in as much as it's not known the precise amount of property either in number or value it's understood that all both real and (page 157) personal is embraced in agreement of both the contracting parties Witness our hands and Seals this 25th day of May 1855 Test Littleberry Bostwick (seal) Lucy A Smith ] her Geo. Lester Clerk Georgia ] In Consideration of the mutual love & affection Oglethorpe County ] which I Littleberry Bostwick of said County Which I have for my dear wife Mildred Bostwick, I do hereby give grant bargain Sell & convey unto my Said wife The following property to wit. A Negro named Harrison a Negro named Louis Negro Boy Henry, a Boy Spencer, a Boy Ellick, a Boy John, a boy Tom, a boy George, a woman Milly, a woman Emily, a woman Julia, a woman Kitty, a girl Mariah, Jane a girl, a girl Caroline & the future increase of said female Slaves. The Dower of the said Mildred in the lands belonging to the estate of Henry P. Colquitt, also Stocks of all kinds including Cows, Hogs, Horses, Mules & the increase thereof. One Barouche, Ox cart, two horse Waggon & farming utensils generally, household & kitchen furniture intending to include in this deed all the property received by my said wife on our intermarriage & the proceeds, profits & increase thereof. To have & to hold Said property unto her the said Mildred as her Sole & separate Property free from all debts & contracts & liabilities of myself or any future husband for & during her natural life & at her death to be disposed of as she may desire by will or otherwise & in Care of a failure on her part to make any such disposition then all of said property to be equally divided between the Children of the Said Mildred or their representatives. Share & Share alike the representatives or grand Children taking in the place of their immediate parent And I the said Littleberry doth & will warrant & forever defend the right & title hereby conveyed against the claims of all persons what soever.
