Oglethorpe County	
	To the honorable Ordinary of said County. The petition of Mathew Varner 
shows that he applied for letters of administration on the estate of John 
Ellis, late of said county diseased, that action of such application has been 
published in conformity to the statue in such case & provided & he now prays 
the court to grant unto him letters of administration on the said Estate of 
said John Ellis, in pursuance of said application, & Citation, & as in duty 
bound, your petitioner will ever prey &c

When hearing the above and forgoing application of Matthew Varner for letters 
of administration upon the estate of John Ellis Decd. It is the opinion of the 
Court that in as much as the Inferior Court of Oglethorpe County while setting 
for Ordinary Purposes has decided that letters of administration should be 
granted to Willis Ellis Sherwood R. Maxwell & Wm. Jewel upon the estate of said 
diseased -------which decision Mathew Varner has applied which appeal is now 
pending & undetermined in the Superior Court of said county this Court has no 
right to grant letters of administration at this time
