All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ga/gafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Beth Collins http://www.genrecords.net/emailregistry/vols/00011.html#0002523 January 7, 2006, 9:54 pm Written: March 1, 1799 Recorded: February 1, 1804 Oglethorpe County Deed Book AA, p. 498 – 499 This Indenture made this twenty first day of March in the year of our Lord one thousand seven hundred & ninety nine Between Robert Burns of the State of Georgia & County of Hancock of the one part and James Smith of the same State & County of Greene of the other part Witnesseth that for an in consideration of the sum of two hundred & thirty dollars to him in hand paid the receipt whereof I the said Burns doth bargain sell convey & confirm unto the said James Smith his heirs and assigns for ever all that tract piece or parcel of land containing by survey two hundred & thirty acres situate lying and being in the State & County aforesaid on the Waters of Shoulderbone creek beginning at a corner red oak running thence S 80 W 30 chs to a Sassafras corner thence S 80 E being a continental line made by said smith and William Caldwell 75 chs. to red Oak thence No 20 E 30 chs to a red Oak thence N 10 W to the beginning with all and singular the rights members & appertenances to the same belonging To have and to hold the said tract or parcel of land unto the said James Smith his heirs & assigns forever as a clear indefeasable Estate in fee simple and I the said Robert Burns agree to & with the said James Smith that I will warrant and for ever defend the legal right and titles in and to the said lands to the said James Smith his heirs and assigns against the lawfull claims of all persons whatsoever and do further agree make and sign any other instrument of Writing that shall be thought necessary for the well authenticating the same In Testimony of the above covenant & agreement I the said Burns have hereunto set my hand & affixed my seal the day and year first above written Signed Sealed & delivered in presence of William Caldwell R.
