Indenture bet James Hartsfield & Bretton Stamps 12 Nov 1812 Oglethorpe Co, GA This Indenture made this twelfth day of November eighteen hundred & twelve Between James Hartsfield of the State of Georgia & County of Oglethorpe of the one part, & Bretton Stamps of the State & County aforesaid of the other part, Witnesseth that the said James Hartsfield for & in consideration of the sum of four hundred & ten dollars to him in hand paid by the said Bretton Stamps at & before the sealing & delivery of the presents, hath granted, Aliened, Sold, released & confirmed unto himi the said Bretton Stamps his heirs & assigns forever all that tract or parcel of land, lying & being in the County aforesaid on big Clancy Creek containing one hundred & twenty Acres which tract of land is a part of an Original tract of land granted to Anthony Olive and which was drawn by Vallsted to Nancy Olive now the wife of the said James Hartsfield by Virtue of a writ of partition from the honorable Superior Court in & for the County aforesaid, to make distribution of the real estate of the said Anthony Olive decd. the said Nancy Olive being daughter & one of the coheirs of the said A Olive decd., and on and by virtue of the distribution aforesaid the said lot of land, which is the tract above mentioned, being know & distinguished in the plan of the said distribution by lot No. 2 Two, and then shown and awarded to the said Nancy Olive now Nancy Hartsfield the wife of the said James Hartsfield & further to distinguish the said lot or tract of land the abuttals & boundaries are as follows to wit, Westerly by lot No. 3 three now owned by the heirs of Charly OKelly decd. Northwardly by James Hale & Samuel Whitehead, land Easterly by Joseph Embry & Billey McElroy Southwardly by Billey McElroy & lot No. 4 in the plan of the said distribution drawn by Elizabeth Olive, which land together with the rights members, and appurtenances thereunto belonging, the said James Hartsfield as aforesaid hath bargained & Sold as aforesaid the said Bretton Stamps to have & to hold by him his heirs forever in fee simple & the said James Hartsfield shall & will Warrant & forever defend the same against all claims whatsoever.
