This file was contributed by: Jeanie Smith Zadach DaisyZ@aol.com ==================================================================== FHC #0158674 Oglethorpe County, Georgia Deed Book D, p. 474-475 June 23, 1804 State of Georgia This indenture made the twenty third day of June in the year of our Lord one thousand eight hundred & four & of American Independence the twenty eighth between John Collier of Oglethorpe County & State of Georgia, Collector of Tax of the one part & Isham Smith of the County & State of the other part. Witnesseth that whereas execution agreeable to an act of the General Assembly of the year one thousand eight hundred & three which act have a reference to an act of the General Assembly for the year one thousand seven hundred & ninety seven containing two hundred acres lying & being in the County of Oglethorpe & State aforesaid & the land being duly & legally advertised agreeable to Law & in the publick (sic) Gazette of this State & was sold on the twenty third day of June one thousand eight hundred & four & Isham Smith being the highest bidder became the purchaser for the sum thirteen dollars & fifty cents. Now I the said John Collier Collector for the County aforesaid for & in consideration of the sum of thirteen dollars & fifty cents to me in hand paid at the signing & delivering of these presents the receipt whereof is hereby acknowledged have this day bargained & sold aliened, conveyed & confirmed unto the said Isham Smith at Collectors Sale agreeable to Law, the above mentioned tract or parcel of land situate & being in the County of Oglethorpe containing two hundred acres being a tract of land granted to Samuel Smith & Richard Bailey adjoining lands of Charles Allen, Zadock Barnett & others on the waters of Long Creek. To have and to hold the above tract or parcel of land together with all & singular the rights members & appurtenances to him the said Isham Smith & His heirs & assigns forever & I the said John Collier Collector for the County so far as the Law authorizes & requires me the said John Collier & he further sells conveys & transfers the premises together the premises together with all & singular the rights, members & appurtenances thereunto belonging in any wise appertaining to him the said Isham Smith his heirs & assigns forever.
