Revolutionary Pension Application

Declaration
In order to obtain the benefit of the third section of the act of Congress
passed July 4, 1836

State of Georgia
Oglethorpe County

On this 12th day of January 1846 personally appeared before me the
subscribed a Justice of the Inferior Court in and for the county aforesaid,
the same being a court of record, Mrs. Sarah Philips, a resident of the
County and State aforesaid, aged eighty five years past as she declares, who
being first duly sworn according to law doth on her oath make the following
declaration in order to obtain the benefit of the provision made by the act
of Congress passed on the 4th day of July 1836. That she is the widow of
John Philips who was a private soldier in the war of the Revolution and
served faithfully in the American cause. That she knows of no person living
who could give a narrative of his services or the names of his officers and
that she has no record or documentary evidence. But according to her best
recollection of what she has always understood and truly believes, the said
John Philips resided in Wake County State of North Carolina and in the year
1778,9 enlisted or volunteered in the services of said State and served a
tour or term of enlistment. That she became intimately acquainted with the
said John Philips about the latter part of 1779 1780, and she thinks in May
1781 the said John Philips again entered the service of the United States as
a private in Col. Thomas Wooten's Regt. and was taken from the line and made
a Cook for (Col. Wooten's) market. His service then continued Eighteen
months. She does not now recollect any other particulars that would aid in
the investigation of her claim. That the power of Attorney hereunto annexed
was given by the said John Philips to Sam'l H. Blythe and at the same time a
transfer was made of two Land Warrants given by the State of North Carolina
to the said John Philips as she always understood for his services during
the War of the Revolution in the Line of said State. Since the death of the
said Philips the agreement has been cancelled by his admin. with the said
Blythe and the power of Atty. given up. But the Land Warrants referred to
she has no knowledge of. And deponent further states that the said John
Philips died on the 26th day of August in the year One thousand eight
hundred and twenty one in the County of Oglethorpe State of Georgia.

And deponent further declares that she was legally married to the said John
Phillips on the fourth day of April One thousand seven hundred and eighty
one by Burrell Pope, Esq. in the County of Wake State of North Carolina.
That her husband died on the day aforesaid leaving her his widow, that she
has remained a widow ever since. That she knows of no person living who
could testify to her legal intermarriage as aforesaid. That she has no
documentary or record evidence of the fact. That the leaf hereto annexed
purporting to be a family register is a true record of her children's ages
and is the only family register ever had and owned by herself and husband.
And it has been in her possession ever since her husband's death and has
gone through no alteration whatever as she can discover. That she is unable
to state whose handwriting the entrys were made in. But knows it to be
an ---- true record.

Sworn to and subscribed on the day and year first mentioned before me, a
Justice of the Inferior Court of Oglethorpe County State of Georgia. I
further certify that Mrs. Sarah Philips the declarant, from bodily
infirmity, is unable to attend court. In testimony whereof I have hereunto
set my hand this the 12th day of January One thousand eight hundred and
forty six.

Be it known that on this 12th day of January 1846 before me William J.
Oglivie a Justice of the Inferior Court in and for the county aforesaid
personally appeared Mark Philips a resident of said county and State aged
fifty seven years past who being first duly sworn saith that he is the
reputed son of John and Sarah Philips the foregoing declarant and according
to his understanding and belief was born on the 10th day of Feby 1785 as
appears from his present family record hereunto annexed which said record
was made and in possession of his said parents to his knowledge for many
years previous to his said father's death and has gone through no
alterations since his death and that the same bears the names of all his
brothers and sisters in the order of their birth, and he has no doubt of its
being a genuine true record of their ages, that it appears to him the entrys
made thereon are in different handwriting & he is unable to recognize or
state whose handwriting either of the entries were made by. That his father
the said John Philips died on the 26th day of August 1826 leaving his said
mother Sarah Philips, the declarant, his widow, and that she is still his
widow, and has remained a widow ever since the period of her husband's
death.

citizen of undoubted veracity. In testimony whereof I have hereunto set my

day of June 1782

Elizabeth Phillips the daughter of John Phillips and Sarah his wife was born
in the year of our Lord 1785, May 13th

Mark Phillips the son of John Phillips and Sarah his wife was born 10th day
of February in the year of our Lord 1788

Delilah Phillips daughter of John Phillips and Sarah his wife was born the
22nd day of November 1790

Richard Phillips son of the above was born the 6th of February 1794

John Phillips son of the above was born the 12th day of May 1797

Sarah Sexon Phillips daughter of the above was born December 25th, 1799

Know all men by these presents that we, John Phillips and John Rice, of the
State and County aforesaid, are held and firmly bound unto his Excellency
Abner Nash, Esq. Governor & his successors in office in the sum of five
hundred pounds curcy to which payment well & truly to be made we bind
ourselves jointly & severally firmly by these presents sealed with our seals
& dated 31st day of March 1781 (seventeen hundred and eighty one). The
condition of the above obligation is such that whereas the above bounden
John Phillips hath this day obtained a license to be joined with Sarah
Sexton in Holy Matrimony. Now if therefore there be no lawful cause to
obstruct the marriage for which the said license was obtained these the
above obligation to be void, else to be and remain in full force & virtue
signed sealed & delivered.

I, Jas. J. Marriott, Clerk of the court of Pleas & Quarter sessions for the
State and County aforesaid do certify that the above is a true and correct
copy of the marriage bond of John Phillips to Sarah Sexton except that the
date of the year seventeen hundred & eighty one is written in the copy &
only figures in the original. In testimony whereof I hereunto affix the seal
of said court & subscribe my name at office this 21st day of January AD
1846.

In person appeared Chesley Arnold, who being duly sworn says that he is
seventy two years of age ~ was born and raised in the State of Virginia and
came to the State of Georgia Oglethorpe County in the month of January 1805,
and resided in the neighborhood of John Phillips and resided near him until
the day of his death and deponent knew the said John Phillips to be a man of
truth and veracity and respectability, and from what deponent heard the said
Phillips and others say, believes him to have been a soldier in the
Revolutionary War of 1776. And deponent also states that he was well
acquainted with Mrs. Sarah Phillips, wife & widow of said John Phillips, &
that said Sarah Phillips was a highly respectable woman, a lady of truth and
veracity, and that she died in the month of March 1847, but the day of the
month, exactly, deponent cannot state but believes it to have been between
the fifteenth & last days of said month of March in the year last aforesaid,
leaving six surviving children & only six who were all well known to
deponent. And the names of said surviving & only surviving children at the
death of the said Sarah Phillips are Elizabeth Nunnally, formerly Elizabeth
Phillips, now the wife of John A. Nunnally; Mark Phillips; Delilah Phillips;
Richard Phillips; John Phillips; & Sarah Tribble, formerly Sarah Phillips,
now the widow & relict of Joel Tribble deceased. And deponent further states
that Mark Phillips was duly appointed by the said John Phillips deceased the
executor of the last will and testament of said John Phillips deceased & has
acted in that capacity ever since the death of said John Phillips & that the
deponent was a subscribing witness to said will.

I, Henry Britain, Ordinary in and for the County and State aforesaid hereby
certify that the above and foregoing deposition of Chesley Arnold was taken
before me & that said Chesley Arnold is a highly respectable and credible
witness & that the evidence of said Chesley Arnold is satisfactory to this
court. And I do further certify that Mark Phillips is the duly qualified
executor as stated in said deposition, and that the deponent Chesley Arnold
is well known to me having for a number of years been acquainted with him as
man of truth and veracity.

Given under my hand and official signature and seal of office at Lexington
in the County & State aforesaid this first day of March eighteen hundred and
fifty three.
