Bacon, Ordinary (Comment - There are many pages in the file so I'll not try to reproduce all of them but here are some highlights. J. R. Cunninghan was the 1st administrator but asked to be dismissed in 1896 saying he was moving out of county and therefore it would be a hardship to continue. This was challenged by Mrs. S. D. Graham saying he had not moved from the county and had not settled with her. However, on April 6th, 1896 J. R. Cunningham was replaced by J. W. Cunningham as administrator by order of J. J. Bacon, Ordinary. The following order has names of legatees so I'm including it. - WDT) Upon reading and considering the foregoing petition it is ordered that George W. Brooks and J. W. Cunningham, Sarah D. Graham, M. A. E. Gunter, H. E. J. Banks, Susan V. Cunningham, all of the County of Oglethorpe and State and C. B. Power and J. O. Power, guardian of Susan V. Cunningham of the County of Madison in said State,: they being the legatees under the will of W. A. Cunningham; deceased; and the children of deceased; be and appear at the next Term of the Court of Ordinary to be held in and for said County of Oglethorpe on the 1st. Monday in March next, to show cause, if any they can, why J. R. Cunningham may not resign his executor-ship of said estate and J. W. Cunningham be appointed in his stead. And it is further ordered that a copy of the foregoing petition and of his order be served personally upon George W. Brooks, J. W. Cunningham, S. D. Graham, M. A. E. Gunter, H. E. J. Banks and S. V. Cunningham of said County and C. B. Power and J. O. Power, guardian of Susan V. Cunningham of the County of Madison at least ten days befoe said next term of Court. This Feb 6th 1896 J. J. Bacon, Ordinary.
