This file was contributed by: TROY COLQUITT telles@elberton.net ==================================================================== James Colquitt’s Will—1836 Will Book D Page 23 State of Georgia Oglethorpe County January Term Georgia ] This is the last will and testament of James Colquitt Deceased of said County Oglethorpe County] I bequeath to my wife Mary Colquitt the use enjoyment and possession of the tract of County & State [ where on I now live containing by estimation Two Hundred and seventy nine and a half acres together with all the profits arising there from during her natural life, and after her death I devise the said tract of land to Nancy Collins, wife of William Collins & her heirs forever. I give and bequeath to my wife Mary the entire property and rights and estate to three negroes to be disposed of at her own pleasure. Either by IOU or otherwise to wit a negro girl named Matilda, a boy named Colonel & a child Delphia, daughter of Fanny. Also two feather beds, bedsteads and furniture together with all the bed covering and clothing. I bequeath to the use, possession , and profits of the following negroes to my wife during her natural life to wit Edmond, Lucy, Martha, Jack and Fanny and at her death to be equally divided together with all the rest of my estate consisting of negroes, land, stocks, hf? between Nancy Collins, wife of William Collins, Patsy Andrews, wife of Buck Andrews and Nehemiah Guthrie to them and their heirs forever. I give to my wife one horse and gig cart and one yoke oxen and as much of my stock as will be necessary for her comfortable maintenance and also it is my will that my wife have as much corn fodder, bacon and other provisions as shall be sufficient for her support during the term of one year from my death. I give and devise to William Collins my Robin Adair colt horse colt.? I will that Nancy Collins, Patsy Andrews and Nehemiah Guthrie being residuary legatees & to have all and every --?---- of my estate both real and personal not herein specifically disposed of. (carried forward) Will Book D-Page 24 Record of Wills, January term, 1836 I hereby nominate & appoint my wife Mary Colquitt and my friend William Collins executors to this my last will and testament hereby revoking & disannuling all other wills by me heretofore made. In witness whereof I here under set my hand and affix my seal this twenty third day of January the year of our Lord One Thousand Eight Hundred and Thirty Four. Andrews } Georgia, Oglethorpe} In addition to my former will I add this my codicil (viz) I give to James Collins County } all the land North of a straight line running from a sweet gum corner on the branch out to James Smith’s line being part of the tract of land I bought of Francis Burke and part of the Henry Dowdy tract and the new fence to be seen on the line and all the balance of my land to my wife Mary Colquitt during her life and it is my will for her to have two beds and furniture with household and kitchen furniture and plantation tools with as much stock of all kinds as she may choose with wagon and gear and one years provision for the same.
