I David Cooper being of sound mind and disposing memory do make and constitute this my last will and testament and form following to wit, Item 1st - I wish all my just debts be paid - Item 2nd - I give and bequeath unto my sister ?Holey? Black during her life that is for her support and benefit all my estate both real & personal and at her death to be equally divided among her children and that Thomas Black have no interest or claim or management of said estate what ever - Item 3rd - I wish my friend William W. Davenport to settle up the mercantile business that now stands open between myself and William G. Tiller, and after paying all the just debts of the concern of Cooper & Tiller to pay over the balance to my Executor for the purposes here after mentioned- Item 4th - I appoint Berry M. David my Executor and earnestly ???????? that he make ample satisfaction to my friend John Crook for all the trouble I have been in his hands and if the amount cannot be agreed on to leave to men - disinterested to give full and fair compensation then the balance after paying all debts to be appropriated as named in item second. In testimony whereof I have set my hand and seal this 13th day of November 1848. ---The word (wish) intentions before assigns -- D. Cooper (Seal) Test - William W. Davenport Robert R. Haynes Wm G. Tiller. Georgia, Oglethrope County -- Court of Ordinary adjournes term Dec 5 1448. The within Last Will & Testament of David Cooper deceased having been exhibited in court and duly proven in open court upon the oaths of Wm W. Davenport and Wm G. Tiler and R. R. Haynes subscribing witnesses to the same and laid over until the regular term of this court for Recod. And Berry M. David who is named and appointed as executor to the said last will and testament being in court but refuses to qualify -- Georgia, Oglethorpe County -- Court of Ordinary January Term 1849. The Last Will and testament of David Cooper late of said county deceased was exhibited and duly proven at the adjorned term of this court held on the fifth day of December last upon the oaths of Wm W. Davenport, William G. Tiller and R. R. Haynes all subscribing to the same, and laid over until the regular term of the court for record.
