Will of William Embrey, Oglethorpe CO. GA Submitted by Wayne D. Tiller The Will of William Embrey Georgia, Oglethorpe County -- In the name of God Amen. I William Embrey of the county & state aforesaid being afflicted in body and now in the seventieth year of my age, but of sound & disposing mind and memory, thanks be to God for the same, and knowing it is appointed for all men to die do mak make, publish & declare this to be my last Will & Testament revoking & disannulling all former Wills by me made. First I recommend my Soul to God who gave it in hopes of its gracious acceptance by him & my body I resign to the Earth to be buried in a decent Christian like manner & as toutching such worldly estate as it has pleased God to bless me with I dispose of in the following manner & form (to wit. Item. I lend unto my beloved wife Frances Embrey during her natural life or widowhood five hundred dollars, one bed bedstead and furniture and on cow and calf and in case she should marry the above named money and property to be equally divided among my children or if she should not marry, to be divided as aforesaid at her heath all that is left after her support which money is to be raised out of the sale of property herein after named. Item. I give unto my Daughter Nancy one negro boy Jerry, one feather bed, bedstead & furniture cow & calf & saddle & bridle that she has at this time, one pine chest & pine table and as much earthenware and kitchen furniture as my other children that is named has had, I give it to her forever. Item. I give to my daughter Biddy one one negro girl Harriet, one feather bed, bedstead and furniture, cow & calf (and saddle & bridle which she has at this time) one pine table and pine chest and as much earthenware and kitchen furniture as my former children have had. I give it to her forever. And it is understood that the above named property that I have left to my two daughters Nancy & Biddy is to make them equal with my children that has left me. My will and desire is that all my land shall be sold and all my other proerty that is not willed away (except my negroes) which together with the money arising from the sale of my property (after reserving five hundred dollars as aforesaid for the support of my wife) I want equally divided between all of my children (to wit, John M Embrey, Thomas Embrey, Nancy Embrey, Joel Embrey, Susannah Johnson, Juley Griffith and Biddy Embrey and I do hereby constitute & appoint my son Joel Embrey & my son in law Isaac Johnson executors to this my last will & testament and I do hereby further appoint the said Joel & Isaac trustees for my wife to act as agents for her and to see that she is taken care of and to take care of the money & property left her and to be used to the most advantagious manner & my wish & desire is that my executors and they are required to take from each of my children a refunding bond (provided the five hundred dollars should not be sufficient to maintain my wife her life time or widowhood) conditioned that each will refund their proportionable part to aid in her support when called on by the executors and be it understood that my executors are to apply the money left to my wife solely to her use or the interest arising therefrom and if there should be any of the money or property left at her death or should she marry then the same is to be equally divided among my above named children.
