GA Submitted by Barbara Walker Winge George Hudspeth Georgia Oglethrope County I George Hudspeth considering the uncertainty of this mortal life and wishing to make such disposition of the property I have accumulated as will in my opinion best promote the interest of my beloved wife and children do make and publish this my last will and Testament in manner and form following 1st My will and desire is that all just debts and demands against me be paid. 2nd I give & bequeath to my beloved wife Amy Hudspeth for and during her natural life, four negroes (viz) Coleman, Richmond, Allen and Choloe and her increase, also the occupancy and use of the plantation on which I now live, together with the Mill, to have, hold, and enjoy the same for and during the term of her natural life, under the following restrictions (viz) If there is more made on said plantation and negroes, than will be a descent support for her, the over plus will be taken by my Executors, for the use of my children, and it is my will and desire that from and immediately after the death of my beloved wife, the said plantation together with the Mill and negroes above named, be taken into possession by my Executors and be apportioned and divided by them among my children, agreeable to the provision hereinafter made. 3rd. I give and bequeath unto my daughter Selina Huddleston five dollars in full of her part of my estate. 4th. I give and bequeath unto my son Charles L. Hudspeth, three negroes, viz., Chrosea, David, and James in full of his part of my property until the rest of my children that are younger than he is are made equal with him. 5th. All the rest residue and remainder of my estate both real and personal (not herein specially disposed of) I give and bequeath to my other children, to be managed and apportioned and divided by my Executors agreeable to the directions following, I desire that all my personal estate (negroes excepted) not necessarily or advisedly sold, by my Executors be kept together, that my negroes be hired out until all my children respectively marry or become of age and then a voluation be delivered by my Executors to the child that so marries or comes of age, and after one valuation and division has been made the residue of the property remain as before, until a second division is necessary, when a like valuation and division has been made until the marriage or maturity of all my children respectively making my son Charles L. Hudspeth equal at my death to a childs part, provided what I have already given him is not equal to the same. 6th. It is my will and request and I earnestly enjoin it on my Executors whom I also appoint the Guardians of my children that all my children but particularly my sons receive the best education that can be given them with the income of their respective shares of the estate 7th. I give and bequeath to my grandson Paschal Paoli Jarrett, one negro girl called Ann and if said negro Ann should die before he becomes of age then my said grandson to have another given him out of my estate of equal value, but should he die before he come of age the said negro girl and increase shall become a part of my estate and be divided among my children as heretofore mentioned but should the above named girl have increase before her death then and in that case no other is to be given him. 8th. I hereby appoint my friends, John Moore, Thomas Duke, Edward Coxe, and Charles Hudspeth Guardian of my beloved children and Executors of this my last Will and Testament now in case of the death of either of my said Executors and guardians of my children the survivors or survivor are and is hereby authorized and requested to appoint some trusty friend to act in the place and stead of the person or persons deceased and the person or persons so appointed are to be considered equally the Guardians of my children and the Executors of my Will, as though they had been appointed by myself hereby revoking all former Wills by me made.
