This file was contributed by: Wayne Tiller wtiller@attglobal.net ==================================================================== Will Book E: Part 1 1863-1886 Page 167 Will of James Jarvis, 1883 State of Georgia, Oglethorpe County -- In the name of God Amen: I James Jarvis of said County and State well knowing the uncertainty of life and deeming while of sound mind and disposing memory to make that disposition of my property which I deem meet? and proper, do make and declare this to be my last Will & Testament. 1st - Intending this to be my last will, I hereby revoke all other wills heretofore made by me. 2nd - I wish my Executors after my death to see that my body is buried in a decent and Christian like manner, and as soon after my death as possible to pay my debts having due regard for the legal priorities of the same, and if a sale of perperty is necessary for that purpose, and empower them to sell the same either at public or private sale as to them seem best. 3rd - After my debts are paid I give to my beloved wife Susanna Caroline Jarvis all the property both real and personal of every kind and description that I may die possessed of, to use and control during her natural life and I empower her to sell or otherwise dispose of any or all of said property that she may deem necessare for her support, either at public or private sale, save that portion of my property embraced in the fourth item of this will which property she is to have the use and control of during her natural life, but at her death is to vest as hereinafter provided. Having full confidence in my beloved wife that she will manage my property after my death with prudence and economy I again repeat that I give her all my property (Save that contained in the fourth Item of the Will) for her maintainance and support during her natural life and if the income from same should not be sufficient for that purpose she is herby fully empowered to sell or dispose of any an all of said property for the above discribed purpose. 4th - After the death of my beloved wife I give and bequeath to Mrs. Martha L C C Harris wife of William Harris and the children of her body the following property to wit: a certain tract or parcel of land known as the Joe Burt Place and containing thirty two acres more or less, also a tract of twenty acres bought by me of Samuel Lumpkin adjoining said lands, and also a tract of four acres to be cut off from my home place adjoining said lands in order that there may be running water on the lands this given to Mrs Martha L C C Harris: and it is my express intention and desire that she and her children shall possess the said sixty one acres more or less for a home free from any control of her present or any future husband. 5th - I give and bequeath to Thomas, John and Filmore Burt, sons of Emsly P Burt and George Harris son of Daniel Harris all the rest and residue of my Estate contained in the third item of this will. Share and Sahare alike after the death of my beloved wife. 6th - I do hereby appoint my wife Susanna Caroline Jarvis George Harris and John R Burt Executors to this will. The last Will & Testament of James Jarvis having been offered for probate in Solemn form of law Joseph H Echols, John W Smith and J W Echols the three subscribing witnesses, being duly sworn deposiths and says that they saw the Testator sign and declare this writing to contain his last Will & Testament, that he signed the same in their presence & they signed in his presence & in the presence of each other, that he was of sound & disposing mind and memory, that he executed the same voluntarily and without compulsion.
