Will of Hezekiah Martin, Oglethorpe CO. GA Submitted by Janice (Johnston) Martin Will of Hezekiah Martin of Oglethorpe Co., GA In the name of God Amen. I, Hezekiah Martin, of the state of Georgia and county of Oglethorpe, being in low health but of sound mind and disposing memory, do make, ordain, constitute, and appoint this to be my last will and testament hereby breaking all former wills, or codicils to wills. After commending my spirit to GOD, the author of it, on touching my worldly goods wherewith I have been blessed, my will is as follows. Item 1-- I will that my funeral expenses, together with all of my just debts, be paid, and that, if possible, without the sale of any part of my estate. Item 2-- I will to my three sons, Cornelius G. Martin, James T. Martin, and George H. Martin four hundred dollars each, to be paid them as soon after the payment of my debts as the money can be raised from the profits arising from my estate, or at any time after my death in property at fair valuation as my Executors may think best for my estate. Item 3-- I give to my four daughters, Sarah Jane Martin, Martha A. W. Martin, Lavena G. Martin, and Edna C. Martin each one horse, one bed, and bed furniture, one cow and calf, and two hundred dollars to be paid them as they come to age of one and twenty or get married, in money or property as directed in Item Second, to them and their heirs and assigns forever, but if either of my above named daughters should die without children, I give the legacy herein left them to be equally divided between the survivors and the children of each of them as may die leaving heirs. Item 4-- I give to my Executors in trust for my daughter Nancy H. Huff, wife of John T. Huff, and her children, one horse, one bed and bed furniture, one cow and calf, and two hundred dollars to be raised as directed in Item Second during her natural life for the use of her and her children and at the death of my said daughter, Nancy H. Huff, I give said property or the remainder thereof to her children forever. Item 5-- I will to my three daughters Polly H., Mildred G., and Lucy, and my two grandaughters, children of my deceased daughter Sophiah R., and my son Charles W., each the sum of one dollar if applied for within one year from my death and no more of my estate forever except as therein after provided for my said son, Charles W. Item 6-- I leave to my beloved wife, Mary Martin, during her natural life, or so long as she remains a widow, the whole of my estate, both real and personal, out of the profits of which arising from the annual crops, the increase of the stock, if possible, to pay the debts of the estate, and the several legacies as herein before mentioned, and to provide a home and support for my daughters while they remain single. She may at one time during her life or widowhood, if she thinks right and proper to do so, give to my son, Charles W. Martin, not exceeding one hundred dollars. Item 7-- I will that at and after the death or remarriage of my wife Mary Martin, my whole estate be divided into five equal portions, then I give one portion to my daughter Sarah J. Martin, one to my daughter Martha A. W. Martin, one to my daughter Lavena g. Martin, one to my daughter Edna C. Martin, and one portion to my Executors to be held in trust for my daughter Nancy H. Huff and her children -- as directed in Item the Fourth. If either of my said daughters should die without issue, then their portion of said estate to be distributed as directed in the Third, provided that if any part of either of said portions shall descend to my daughter Nancy H. Huff, the same shall go to be held in trust as in Item the Fourth. Item 8-- I do hereby appoint my beloved wife, Mary Martin, Executrix, and my trusted friend A. Leseur, Executors, to carry this my last will and testament into effect.
