Will of Mrs. Martha A. Martin, 1853, Oglethorpe Co. GA Submitted by Wayne D. Tiller Will of (Mrs.) Martha A. Martin The Will of Martha Martin - Will Book D 1833 - 1864 Page 528 Court of the Ordinary November term 1864. In the Name of God - Amen, I Martha Martin being at this time in ordinary health and of sound and disposing mind and memory do make and ordain this my last Will and Testament in manner and form following (to wit) Item 1st - I wish all my just debts paid and my body decently buried, Itme 2nd - I wish my two Negros Lucy and Jeff to be apprasied by three ???????? and that my sons Mitchell M and William L to take them at what they are appraised at or have them sold as they may think best and the proceeds of the sale or appraisement after paying all my just debts the balance to be equally divided between Mitchal M Martin, William L Martin, Elizabeth Tiller, Martha Tiller, William G Ham and Victoria Tiller. Item 3rd I give and bequeath to my two sons Mitchel M and William L Martin all the property real or personal of whatever kind I may die possessed of except the negros named in Item second, Item 4th I give the Legacy named in Item second to Victoria Tiller to be placed in Mitchel M Martin's hands for her use and benefit and in case she dies before she becomes of age or marrys the legacy bequeathed to said Victoria to go to the children of Elizabeth and Martha Tiller. Item 5th it is my wish, in case either of my sons should die before receiving the Legacy named in Item Third that the surviving one take all as named to the two. Item 6th I constitute and appoint my two sons Mitchel M and William L Martin my true and lawful executors to this my last will hereby revoking all other wills made by me. Davenport State of Georgia, Oglethorpe County - Personally appeared in open court Ambrose Witcher one of the subscribing witnesses to the within and after being duly sworn depseth and saith that he saw Martha A Martin sign, seal publish and declare the within to be her last Will and Testament and at the time thereof she was of sound disposing mind and memory and that she did it freely without compulsion and that deponent with William W Davenport and Charles N Davenport signed the same as witnesses in the presence of the testator at her special instance and request all of which is to the best of his knowledge and belief so help me God. The Last Will and Testament of Martha A Martin late of Oglethorpe County deceased was exhibited in open Court by Mitchel M Martin one of the executors therein named and duly proven in common form of law at this regular term of the Court in open court upon the oath of Ambrose Witcher one of the subscribing witnesses to the same orders that said will be admitted to probate and be Recorded.
