Will of Robert Noell - Oglethorpe Co GA Submitted by Wayne Tiller Will of Robert Noell The Will of Robert Noell from Oglethorpe County Will Book A Georgia -- Oglethorpe County -- In the name of GOD amen, I Robert Noell of the county and state aforesaid, being sick & weak in body, but of sound mind & perfect memory, knowing that it is appointed for all men once to die, do make and ordain this my last will & testament, in manner following, first I recommend my soul to almighty GOD who gave it, & my body to the earth, to be buried in a neat Christian manner by my executors hereafter named, and as to my worldly goods which GOD hath given me to be disposed in the following manner. Item. It is my desire that all my just debts be paid and those due me collected. Item, I lend my beloved wife Mary Noell the tract of land whereon I now live with all the plantation utensils & tools belonging there unto, also my negroes together with all my stock of every kind, the household & kitching furniture, all of which I lend my wife during her natural life, & it is my will and desire that if my daughters Elizabeth H Noell & Frances Noell, shall remain single, both, or either of them, at the decease of their mother, that then, & in that case I lend the plantation to them, so long as they remain unmarried, and at the death of my wife, & the marriage of both my above named daughters, I give the said tract of land to my youngest son Beverly Noell to him & his heirs forever- Item, I give unto my son James Noell one feather bed & furniture. Item, I give unto my son John C. Noell one feather bed & furniture. Item, I give unto my daughter Elizabeth Noel one feather bed & furniture & thirty dollars in cash - - Item, I give unto my daughter Francis Noell one feather bed & furniture and thirty dollars in cash - Item, I give unto my son Robert Noell one feather bed & furniture Item, I give unto Thomas Noell one feather bed & furniture Item, I give unto my son Beverly Noell one feather bed & furniture Item, It is my will and desire, that at the death of my wife Mary Nowell, that all that part of my estate that came by her, be equally divided among all of her children, viz. Jas. Noell, Mary Hazlegrove, Elizeth Noell, Stephen Noell, Francis Noell, Robert Nowell, Thomas Noell, Beverly Noell, & John C. Noell, & that part of my estate that did not come by my wife Mary Noell, & not otherwise divided be equally divided amongst all of my children, taking in with those above named Larkin Smith & Charles Noell, I give it to them & their heirs for ever -- Item, it is my will & desire that if either of my children that are now married, or may be married, should die before my wife that, that part of my estate alotted to them, be equally divided amongst their children, if any, if none, their proportionable part to be equally divided amongst the surviving children -- Item, I hereby constitute & appoint my beloved wife Mary Noell Executrix, James Noell & Robert Noell Executors to this my last will & testament, in witness whereof I have hereunto set my hand and seal this 20th of February 1811 - in addition to the above I give my son Beverly Noell one Sorrel Stud Colt, to be delivered to him, when he arrives to the age of twenty one years - & if the said colt should die previous to his becoming of age, the loss to be made up out of my estate before the division - Witness my hand this the day & year first above written - his Robert X Noell (Seal) mark This instrument of writing acknowledged Signed and Sealed in presents of us -- A G Smith his Thos.
