Nunnely Wm B. Brightwell & F. C. Campbell are held and firmly bound and obliged unto the Ordinary of said County for the time being, and his successors in ofice, in the sum of Two thousand Dollars, to be paid to the said Ordinary, his sucessors in office, or assigns: for which payment, well and truly to be made and done, we bind ourselves, jointly and severally, and each of our heirs, executors and administrators, firmly by these presents. Sealed with our seals, and dated at Lexington the sixth day of September in the year of our Lord one thousand eight hundred and fifty three -- Whereas, Mrs Ava Noell late of said County and state deceased; died intestate, having, whilst she lived, at the time of death, ?divers? Goods, Chattels and Efects and Credits with the County and State aforesaid: And whereas the above bound Jacob G. Nunnelly has made application to the said Ordinary, for Letters of Administration on the estate and effects of the said Ava Noell deceased, but the time limited by law, for the granting of the same, not having expired, and the Goods and Chattels of the deceased being liable to be wasted and injured, unless authority is granted, to some person to collect and keep the same together until administration thereon shall be granted. Now, the Condition of the above Obligation is such, That if the above bound Jacob G. Nunnelly do and shall faithfully collect, gather and keep together, the Goods, Chattels and Effects of the said Ava Noell deceased, without impeachment of waste, or charge of waste, or improper management of the property shich shall come into his possession; or for any transactions concering the same, until legal adminiatration shall be granted thereon, and in the mean time render into the office of the Ordinary of said County, an account of his actings and doings therein; then this obligation to be void, otherwise remain in full force and virtue. Nunnely as principal and William B. Brightwell & Pendleton S. Fambrough are held and firmly bound and obliged unto the Honorable the Ordinary of said county, for the time being, and his successors in office, in the sum of Sixteen hundred Dollars, to be paid to the siad Ordinary, his successors in office or assigns, for which payment well and truly to be made and done we bind ourselves jointly and severally, and each of our heirs, executors and administrators, firmly by these presents. Sealed with our seal and dated at Lexington the seventh day of November in the year of our Lord one thousand eight hundred and fifty three. The Condition of the above Obligation is such, That if the above bound Jacob G. Nunnelly administrator of the goods, chattels and credits of Mrs Ava Nowell deceased, do make a true and perfect inventory of all and singular the goods, chattels and credits of the said deceased, which have or shall come to the hands, possession or knowledge of the said Jacob G. Nunnally or in the hands or possession of any other person or persons for him and the same ?? made do exhibit in the Court of Ordinary of said county when he shall be thereunto required, and such goods, chattels and credits, do well and truly administer according to law, and make a just and true account of his actings and doings therein when required by the Superior Court or the Ordinary for the said county, and all the rest of the goods, chattels and credits which shall be found remaining upon the account of the said administration, the same being first allowed by the said Court, shall deliver and pay to such persons respectively as are entitled to the same by law. And if it shall hereafter appear that any last Will and Testament was made by the said deceased, and the same be proved before the Court, and the executors obtain a certificate of the probate thereof, and the said Jacob G. Nunnally do in such case, if required, tender and deliver up the said letters of administration, then this obligation to be void, else to remain in full force. Signed, Sealed and Delivered / Jacob G.
