The Condition of the above Obligation is Such, that if the above bound Seymore Lee Admin of the goods, chattels and credits of James Nowell late of this county deceased, do make a true and perfect inventory of all and singular the goods, chattels, and credits of said deceased, which have or shall come to the hands, possession or knowledge of the said Seymore Lee or into the hands or possesion of any other person or persons for him and the same, so made, do exhibit in the said court of ordinary, when he shall be there-unto required; and such goods, chattels and credits, do well and truly administer according to law, and do make a just and true accout of his actings and doings therein, when he shall be thereunto required by the court of ordinary for said county, and all the rest of the goods, chattels and credits, which shall be found remaining upon the account of the said administration, the same being first allowed of by the court, shall deliver and pay to such person or persons, respectively, as are entitled to the same by law; and if it shall hereafter appear, that any last will and testament was made by the said deceased, and the same be proved before the court and the executors obtain a certificate of the probate thereof, and the said Seymore Lee do, in such case, if required, render and deliver up the said letters of administration, then this obligation to be void, else to remain in full force. Peterman represents to his Honorable Court, that he has lately married Malissa Nowell one of the distributes of the estate of Jas. Nowell decd. & as such is now entitled to one share of said estate. He therefore applies to your Honorable Body & prays the appointment of three or more freeholders of the County to divide the distributable estate of the said Jas. Nowell into as many parts or shares as there are distributees & assign by lot or otherwise as to them shall seem proper one of the shares to your petitioner. Whereupon it is ordered that Pleasant Robertson, James Donnahoo and Chesley Arnold & John Colquit - or any three of them be & they are hereby appointed and authorized, after being previously sworn to make the same according to (words scratched out) without favor or affection to any of the parties, to the best of their ???? and understanding, to make a division of the distributable estate of Jas. Nowell decd, into as many shares or parts as there are distributees of said estate and to assign by lot or therewith as to them shall seem proper, one of said shares or parts to Henry G. Peterman. Jan 18th 1834 We the under signed have denoted the Negroes belonging to the estate o James Nowell Dec. in complyance with an order ?????? from the Hon. Inferior Court of said County and hath given to Henry G. Peterman to divide & assign to him his share of the distributable estate of Jas Nowell decd, executed said order only so far as the negroes of said estate were concerned, and the said Henry G. applies again to this Court for a further appointment of Freeholders to divide the personal estate of said Jas. Nowell except the negroes, & assign to him his share thereof - It is thererfor ordered that Pleasant Robertson, Chesley Arnold & William Patman be & they are hereby appointed and authorized after being previously sworn to make the same according to Justice and equity without favor or affection to any of the parties to the best of their skill & understanding to make a division of the person estate (negroes excepted) of James Nowell decd into as many parts or shares as there are distributees of said estate, and to assign by lot or otherwise as to them shall seem proper one of said parts or shares to Henry G. Sealed with our seals, and dated this the second day of November one thousand eight hundred and forty -- The condition of the above obligation is such, That whereas the said David W. Patman this day appointed Guardian to Jas Thomas Nowell -- Now if the said David W. Patman do well and truly demean himself as Guardian aforesaid, agreeably to Letters of Guardianship bearing even date herewith, and agreeably to law, in such case made and provided the above obligation to be void, otherwise to remain in full force and virtue. Cook Security - are held and firmly bound unto their Honors the Judges of the Inferior Court sitting for Ordinary purposes for said county, and their successors in office, in the just and full sum of Eight Thousand dollars, for the payment of which sum, to the said Judges and their successors in office, we bind ourselves, our heirs, executors and administrators, jointly and severally, fimly by these presents. Sealed with our seals, and dated this Second day of November one thousand eight hundred and forty. The Condition of the above obligation is such, That whereas the said Huldah Nowell - is this day appointed Guardian to Seymore L Nowell and Martha Nowell - Orphas of Jas Nowell decd. - now if the said Huldah Nowell Guardian as aforesaid -- do well and truely demean herself as Guardian aforesaid, agreeably to Letters of Guardianship bearing even date herewith, and agreeably to law, in such case made and provided, the above obligation to be void, otherwise to remain in full force and virtue. Admited Henry Britain C.C.O. Examined and Sworn to 16th August 1843. Georgia, Oglethorpe County / To the Honourable the Inferior Court of said County while sitting for Ordinary purposed September Term 1842 - The Petition of Mrs. Hulda Nowell the Administratrix de donis non upon the estate of James Nowel deceased shows that she has fully discharged the duties assigned her as Administratrix of said estate as aforesaid - therefore it is ordered that the Clerk of this Court issue a Citation Requiring all persons concerned to show cause if any they have on or before the first Monday in May next why said Administratrix should not be discharged, it is also further ordered that said citation be published in the Southern Recorder one of the public gazettes of this state for the space of six months - A true Extract from the minutes of the Court of Ordinary held September Term 1842. The petition of Mrs Hulda Nowel the Administratrix de bonis non upon the estate of James Nowel deceased showith that at the September Term of this Court 1842 the said Administratrix did petition said Court to be discharged from her Administration of said estate, and it further appearing to this Court that the same has been published agreeable to Law & it also further appearing to the Court that the said Administratrix has discharged her duty as Administratrix of said estate and that having been no objection filed or case shown to the contrary. It is therefor ordered by this Court that the ?????????? to her letters of Dismissial for said estate & that she be dismissed and discharged from her Liability as Administratrix of the estate aforsaid as terms of the Law in such cases make & provide - Atrue Extracted from the minutes of the Court of Ordinary May Term 1843.
