Know all Men by these Presents, That we Thomas M. Fambrough and P. S. Fambrough are held and firmly bound unto his Honor, E. C. Shackelford the Ordinary of said County for the time being, and his successors in office, in the just and full sum of Fourteen hundred Dollars; for the payment of which sum to the said Ordinary, and his successors in office, we bind ourselves, our heirs, executors and administrators, in the whole and for the whole sum, jointly and severally, firmly by these presents. Sealed with our seals, and dated this Seventh day of March 1864. The Condition of the above Obligation is such, That whereas the said Thomas M. Fambrough was this day appointed Guardian to William A Noell James W Noell Mary D Noell and Robert G Noell minors of Susan J. Noell deceased Now, if the said Thomas M Fambrough do well and truly demean himself as Guardian aforesaid, agreeable to Letters of Guardianship, bearing even date herewith, and agreeably to law, in such case made and provided, the above obligation to be void, otherwise to remain in full force and virtue. Georgia, / Before me, E. C. Shackelford, Ordinary of said County, personally came Oglethorpe County / Thomas M Fambrough Guardian of William A. Noell, Robert G. Noell, James W Noell and Mary D Noell minors, who being duly sworn saith on oath that in pursuance of an Act of the Legislature of Georgia, assented to 18th April 1863 entitled "An Act to authorize Executors, Administrators, Trustees and Guardians to receive Confederate Treasury Notes and State Treasary Notes and interest bearing Confederate notes, in payment of claims due, or to be due such estates as they may represent", he did, on or about the 7th day of March 1864, bonafide receive in payment of a claim or claims due the estates of his said wards, from Pendleton S. Fambrough Trustee for Susan J Noell & her children, the sum of Two hundred and nineteen dollars & thirty two cents ($219.32) in confederate Treasury Notes for each of his said wards, making in the aggregate the sum of Eight hundred and Seventy Seven dollars & twenty eight cents in Confederate Treasary Notes. So received by him - that he paid out for each of said wards the sum of nine dollars & twenty eight cents ($9.28), making in the aggregate the sum of Thirty seven Dollars and twelve cents ($37.12) paid out in said Confederate Treasury as will appear by reference to his Returns filed in the Ordinary's office of said county March 7th 1864 that he, as such Guardian, still holds a balance of Eight Hundred and Forty Dollars and sixteen cents ($840.16) of said Confederate Treasury Notes so received & invested by him as aforesaid, and held the same when the Confederate cause failed, and that said funds so invested in said Confederate Treasary Notes belong, bonafide to the estates of said William A, Robert G, James W and Mary D Noell. And deponent further swears that the Confederate Treasary Notes aforesaid, namely $840.16, so held by him, is the same kind of currency which he received for the estates of said wards so represented by him as Guardian.
