Will of John Settle 14 Sep 1858 Oglethorpe County, GA Will of John Settle 14 Sept 1858 Oglethorpe Co, GA ____________________ Georgia Oglethorpe County In the name of God, I John SETTLE of the county and State aforesaid, being at this time in bad health, but believing myself of sound disposing mind and memory, do make and constitute this my last will, in manner and form following, to wit; Item 1st: I wish all my just debts paid. Item 2nd: My wish and desire is that my estate be kept together as it now is for the support of my wife and children, and that my children be educated out of the proceeds of my estate until my youngest child shall receive her education, and as my children become of age or marry, except my son David F., each one to have a negro given them worth Seven Hundred dollars, or that amount in money, as my executors think best for the estate, and if they receive a negro it to be valued and the child either receive in money to make the amount of Seven Hundred dollars, or pay back to the estate as the case may be to make that amount, and one bed, bedstead and furniture to each of my children as they become of age or marry to receive the above legacy. Item 3rd: I constitute and appoint my son in law John W. MARTIN trustee for my son David F., for him to manage the portion of my estate going to my son David F., so that my son have the use and benefit of it, but not to be subject to his disposal, only the profits arising from said portion. Item 4th: I have given off to my children that have married and left the following amounts; to my son William M. SETTLE a negro girl priced at Six Hundred and Fifty dollars, and bed and furniture -- to my son James S. SETTLE a negro boy priced at Six Hundred and Seventy Five dollars and bed and furniture; and to my daughter Susan Ann MARTIN, a negro girl priced at Seven Hundred dollars, and bed and furniture. My wish and desire is that my two sons be made equal with my daughter out of my estate. Item 5th: My wish and desire is that all my estate both real and personal remain together after my children become of age and receive their portions as before named, for the use and benefit of my beloved wife Mary SETTLE during her widowhood and at her death an equal division among all my children and the legal heirs of them that may be dead, and if my wife should marry at any time I give her one third of my land and the same as I have given to my children. Item 6th: I hearby constitute and appoint my son in law John W. MARTIN and my son William M. SETTLE executors to this my last will and testament.
