Tiller The Will of Joseph Smith, 1871 Oglethorpe County Book E Part 1 1863-1866 Page 51 State of Georgia, Oglethorpe County -- In the name of God Amen. I Joseph Smith of said State and County being of advanced age but of sound and disposing mind and memory knowing that I must shortly depart this life deem it right and proper both as respects my family and myself that I should make a disposition of the property with which a kind Providence has blessed me. I do therefore make this my last Will and Testament hereby revoking and annulling all others by me heretofore made. Firstly I desire and direct that my body be buried in a decent and Christian like manner suitable to my circumstances in life. My soul I trust shall return to rest with God who gave it as I hope for salvation through the merits and atonement of the blessed Lord and Savior Jesus Christ. Secondly I desire and direct that all my just debts be paid without delay by my Executor hereinafter named and appointed. Thirdly I give, bequeath and devise to my beloved wife Martha my home tract of land on which I now live in Simston District containing Eight hundred acres or the same more or less with all the rights members and appurtenances to said lot of land in anywise belonging free from all charge and limitations whatever to her own proper use, benefit and behalf so long as she remains a widow and I also give and bequeath to my beloved wife in the same un-reserved manner the farming utensils used in and belonging to the farm on said lot of land, and all of the stock that is on said farm consisting of horses and mules, cows, hogs and sheep except one horse that I have given to my youngest son Richard C. Smith. And I also give to my beloved wife, all of household and kitchen furniture and at her death or if she should marry it is all to be sold and equally divided amongst my children. Thirdly I give and bequeath to my son Richard C. a horse by the name of Bob, bridle and saddle extra out of my Estate. Fourthly I give and bequeath to my daughter Margaret A. Glenn a side saddle and seventy five dollars extra out of my estate when it is wound up by the Executor. Fifthly I give and bequeath to my daughter Mary F. Turner a side saddle, and seventy five dollars extra out of my estate when it is wound up by the Executor. Sixthly I give and bequeath to my daughter Susan C. Smith a side saddle and seventy five dollars extra out my estate when it is wound up by the Executor. Seventhly I give and bequeath to my daughter Martha J. Smith a side saddle and seventy five dollars extra out of my estate when it is wound up by the Executor. Eightly I hereby constitute and appoint my son John W. Smith Executor of this my last Will and Testament this April 28th 1871.
