Tiller - Will Book D 1833-1866 Page 319 Georgia, Oglethorpe County -- In the name of God Amen. I Mitchel D. Tiller of the County & State aforesaid, being of sound disposing mind and memory, though feeble in Health and knowing that life is uncertain do make and ordain this my last Will and testament in manner and form following to wit. Item first I wish all my just debts paid and my body decently buried - Item 2nd - I give and bequeath to my beloved wife Elizabeth G. Tiller during her natural life or Widowhood, all my estate both Real & personal to manage and Act with as her own and my wish and desire is that she Raise and Educate and Cloath my children as she may feel able to do with the effects I may leave at my death, after paying all my just debts ---- Item 3rd - I wish at the death or marriage of my wife that there should be an equal division of my Estate between my wife and two Daughters Sidney M and Sephronia A. and at her death without her marrying my Estate to be equally divided between my two Daughters, and that my estate be kept together for the purposes named in Item Second, and all the Interest accruing to the Estate to be managed as my wife may think best for her own benefit and the Interest of my Estate. Item 4th - It is my wish that if Milly Ann Black wishes to remain with my wife and they get along agreeable, that she do so and that my wife give her whatever she may think proper to do at her own discretion, but if they should not agree and get along well, that Milly Ann should leave my family -- Item 5th - I Constitute and appoint my beloved wife Elizabeth G. Tiller my Executrix and my friend and Brother in Law Mitchel M. Martin my Executor to this my last Will and testament. Tiller deceased having been exhibited in Court, and duly proven at this Regular Term of the Court, in open Court upon the Oaths of William G. Ham, John L. Davenport and Mitchel M. Martin all subscribing witnesses to the same. Ordered that the same be Admitted to Record. Recorded the 7th day of September 1854 Henry Britain Ordinary
