This indenture made this 6th day of Sept. in the year of our Lord one thousand nine hundred and nine between J.H. Heath xxxxxxxxx State of Ga. county of Milton of the first part and J.P. Heath of the state of Ga. and county of Dawson of the second part Witnesseth: that the said party of the first part for and in consideration of the sum of five Dollars in hand paid at and before the sealing and delivery of this present the receipt whereof is hearby acknowledged has granted bargained and sold and conveyed and by thes presents does grant bargain and sell and convey unto the said party of the second part his heirs and assigns all his interest in that track or parcel of land lying and being in the county of Pickens and state of Ga. to wit: four acres in the south west corner of the lot of land no. 128 including a dwelling house and being in the 4th dist. and the second section of the said county of Pickens togeather with all the rights and privaleges whith the said J.H. Heath had in and to said track or parcel of land to have and to hold the said bargained premesis togeather with all and singular the rights members and apputenances thereof to the same being belonging or in any wise appertaining to the only proper use benifit and behoof of the said property of the second part his heirs and assigns forever in fee simple and the said party of the first part his heirs exeuctors and administrators will warrant and forever defend (illegiable) of the above described property unto the said party of the second part his heirs and assigns against the claims of all persons whomsoever in witness whereof the said party of the first part has hereunto has set his hand and affixed his seal the day and year first above written signed sealed and delivered in presence of S.I. Kirby J.H. Heath (seal) H.S. Kirby J.P. in and for the 989 dist. G.M. of Dawson County Ga. Recorded March 5th. 1910 Elias Whitfield C.S.C. Additional Comments: J.P. Heath is James Paul Heath b-1860 Cherokee Co. GA. d-1930 Pickens Co. GA. buried at Four Mile Baptist Church, Pickens Co. GA. father and mother were: James Heath and Francis Yancy.
