Blackburn It appearing to the court on the showing of Spencer Stamper one of the admrs of the estate of Irby Stamper deceased that they had in terms of the law published their notice that they would apply to this court for an order to sell all the real [ blank] estate of said deceased & it further appearing that no objection had been made or filed in the clerks office of said county. Johnson was unamiliousy declared elected Georgia Pike County Court of Ordinary Jay Term 1837 It appearing to the court that Robert Hudson in his lifetime executed unto Denson Crow a bond in which he bound himself to make titles to a parcel of land to wit three acres lying on the road leading from the Flat Shoals on Flint River to Powder Creek it being in the north west corner of lot number fifty seven in the ninth dist. Formerly Monroe now Pike County & State of Georgia & it appearing that the said Robert Hudson has departed this life without making titles to Said land & it appearing that the said Crow has paid the entire consideration for said land to the administrator of said Robert Hudson & is willing to make titles when authorized by the court It is therefore ordered by the court that Charles McDowell the admr of the estate [continued on next page] PAGE 123 Of the said Robert Hudson deceased do make titles unto the said Denson Crow to & for said land The court adjourned till Saturday the 14th next J. Andrews admr & admix of the estate of Wyatt T. Andrews deceased that they had in terms of the law published their notice that they would apply to the court for an order to sell the lands belonging to the estate of said Wyatt T. Andrews decsd & it further appearing that no objection had been made or rendered unto the clerk of the court. It is therefore ordered that they are hereby authorized to sell the land of said estate. Daniel alias Sabina G. Reeves petitions this court to revoke the guardianship of Egbert P. Daniel guardian of the person & property of Joseph H. Daniel orphan & minor son of said Sabina G. Reeves on following grounds (viz) 1st An infant under fourteen years of age has the right to chose his guardian 2nd That George W. Reeves in right of his wife is entitled to said guardianship 3rd That Egbert P. Daniel guardian as aforesaid is speculating & loaning his wards funds at more than lawful interest & accounting for same with only lawful interest It is herefore ordered by the court that Egbert P. Johnson CCO PAGE 140 Georgia Pike County Inferior Court Sitting for ordinary purposes Sept adjourned Term 1837 It appearing to said court that heretofore letters of administration were granted by this court to Richard Hunter, David Crawford [marked out] & Rebecca Crawford on the estate of John Crawford deceased & it appearing to said court that the said John did not die intestate, but left a will which has at this term been proven & admitted to record & it also appearing that Gideon Barnes & David Crawford the executors appointed in said will have come forward & qualified to execute said will & it also further appearing that all the said administrators are in court present & make no objections, it is therefore ordered by the court that said letters of administration be by said admr delivered to the clerk of this court & that the same be hence forward revoked annulled & it is further ordered by the court that said Richard Hunter, David Crawford [marked thru] & Rebecca Crawford deliver over to said executor all the property money, notes & effects that have come in their possession respectively or in the possession of any other person for them belonging to said estate - and it is further ordered that if either of said administrators has purchased or [ _ ] any of the property of said estate & has not accounted therefore by making notes agreeable to the terms of said purchase or hire, that they do now make said notes or pay the money over to said executor in [ _ ] to the understanding at the time of such transaction & it is further ordered by the court that all reasonable & legal costs accrued in the management of said estate by said admr be [ _ [ by them ======== Ordered that Richard Hunter be & he is hereby appointed guardian of the person & property of William Sneed orphan of [ blank space ] Sneed late of Hancock County decd. To make titles unto the said Harrison Crow to lot of land no. 69 in the 19th Dist. Of formerly Lee County. It is therefore ordered by said court that persons interested show cause by or before the expiration of three months after service of this rule, be perfected why said administrator shall not be directed to make titles according to the original bond filed in this office & it is further ordered by said court that service of this rule be perfected by a three month publication according to law The Court adjourned till court in course this 25th Sept 1837 J. Reid Executor of the estate of John Reid late of said County deceased that he had in terms of the law published his notice, that he would apply to this court for an order to sell a part of the real & personal property of said estate to pay the debts & for the benefit of the heirs of said estate & no objection having been made or filed in clerks office of the court. It is therefore ordered that said executor be & he is hereby authorized to sell a part of the personal & real property of said estate ========= Ordered that Henry Jones be & he is hereby appointed guardian of the person & property of Nancy A. Dunn orphan of Gatewood Dunn late of Jasper County deceased on his giving bond & security in the sum of two thousand dollars whereupon he gave William Pryor for security & was qualified in terms of the law PAGE 145 Ordered that Francis S. Martin be & he is hereby appointed guardian of the person & property of Bethia Muckleroy alias Bethia Andrews orphan & minor child of [ S---] Muckleroy alias [ S----] Andrews late of said county deceased in giving security in a bond of two thousand dollars when he gave Joseph R. Martin and Jeptha V. George for security & was qualified in terms of the law ========= Ordered that Richard Scruggs be & he is hereby appointed guardian of the person & property of James Scruggs orphan & minor of James Scruggs late of Columbia County deceased on his giving security in a bond of five hundred dollars when he gave David Cardin for security & was qualified in terms of the law ========= Ordered that Tolliver Maddin be & he is hereby appointed Administrator of the Estate of David Maddin Senr. Late of said county deceased on his giving security in a bond of five hundred dollars when he gave John Heatley for security & was qualified in terms of the law ========== James M. Maddin one of the securities of David Maddin ( guardian of the person & property of Sarah E. Wise minor & orphan of Joel Wise late of Jasper County dec’d) has by letter [ following marked thru] requested of this court [end of mark thru ] complained of the management of said orphans estate by David Maddin guardian PAGE 146 As aforesaid. It is therefore ordered that said David Maddin guardian as aforesaid be & appear at the court of ordinary to be held in first Monday in December next to show cause why his letters of guardianship shall not be revoked and on his failings so to do the court will proceed as law & justice require ======== It appearing to the court on the showing of Jas. & John Neal, guardians of the orphan of David Neal late of the state of Alabama deceased, that they had in terms of the law published their notice that they would apply to this court for an order to sell the Negroes belonging to said orphan for their benefit & division & no objection having been made or filed in the clerk of this county office - it is therefore ordered that said Jas & Jno Neal guardians as aforesaid be & they are hereby authorized to sell said Negroes for the purpose abovementioned ========= It appearing to this court that Samuel Clark in his lifetime entered into a bond or obligation to make unto Daniel R. Biler [? Biles] good & warranty titles to lot of land No.86 in the 3rd district of originally Monroe now Pike County & it also appearing that he has departed this life without performing the same or making any provision therefore by will or otherwise, & it also appearing that Thomas R. Bond has taken out letters of administration on the estate of [continued on next page] PAGE 147 the said Samuel Clark deceased wherefore all persons concerned are hereby notified that the said Thomas R. Bond administrator of the said Samuel Clark deceased will be directed by this court after the legal publication of this rule, to make titles to the said Daniel R. Biler for the said lot of land unless good cause be shown by that time to the contrary & it is ordered by said Court that service of this order be perfected by a three month publication of the same in one of the public gazettes of the State & in some of the public places of the county ========= Ordered (by consent of parties) that Joseph H. Daniel minor & orphan child of Lumford R. Daniel late of said county deceased be & appear at the next January Term of this court then & there to choose a guardian of his person & property provided he does not choose E. P. Daniel or George W. Reeves ========= It appearing to the court on the showing of Willis J. Milner & Jonas Shivers guardian of the orphans of William W. Arnold dec’d that they had in terms of the law, published their notice that they would apply to this court for an order to sell a certain lot of ( no. not recollected) in the third district of Monroe County, for the use & benefit of said orphans. It is therefore ordered that they the said guardians as aforesaid be & they are hereby authorized to sell said lot of land PAGE 148 It appearing to the court on the showing of Abraham D. Wood admr of the estate of Francis Wood late of said county dec’d that he had in terms of the law published his notice that he would apply to this court for an order to selll part of lot of land no. 105 in the first district of originally Monroe now Pike County & it further appearing that no objection had been made or filed in the clerks office of this court It is therefore ordered that said Abraham D. Wood admr as aforesaid be & he is hereby authorized to sell said land ========= Ordered that John L. Blackburn, Egbert P.
