Stamper orphan of Irby Stamper dec’d vs. Hugh G. Wright Hugh G. Wright being dissatisfied with the appointment of said Martin W. Stamper to the guardianship of the person & property of said Sophia L. Stamper orphan & minor child of Irby Stamper dec’d comes forward in terms of the law & pays all costs, dues & demands an appeal which is granted by the said Hugh G. Wright & Allen Cook his security acknowledging themselves their heirs executors & assigns jointly & severally bonded to him the said Martin W. H. Milner & Justices J. C. Adkins Georgia Pike County Ordinary Court March Term 1838 It appearing to the court that Daniel R. Biles has paid to Thomas R. Bond admr of Samuel Clark dec’d the condemnation money which the said Daniel R. was to give the said Samuel Clark dec’d for Lot of land no. 86 in the third dist. of said county and it appearing to said court that the said Thomas R. admr as aforesaid is unable to produce the notes made by the said Daniel R. securing unto the said Samuel Clark said money & it not being known but what & innocent & bona fide holding now on the notes & hereafter [ _ ] [ _ ] on the said Daniel R. for the payment thereof. Mangham orphan child of Wiley Mangham late of said county deceased be & the same is hereby revoked & set aside Ordered that Wiley E. Mangham be & he is hereby appointed guardian of the person & property of Wiley A. Mangham orphan child of Cynthia Mangham late of Chambers County Alabama [ _ ] on his giving bond & security in a sum of eighteen hundred dollars, whereupon he executed the bond as directed by the court & gave John N. Stamper admrs of the Estate of Irby Stamper deceased that they had in terms of the law published their notice that they would apply to this court for leave to sell all the Negroes belonging to Sophia Stamper orphan & minor of said Irby Stamper dec’d & it further appearing that no objection has been made or filed in clerks office It is therefore ordered that they are hereby authorized to sell all the Negroes belonging to said orphan ======= Whereas Mary B. Crawford guardian of the minors & orphans of Andrew Crawford Sr. deceased late of Abbeville [ _ ] S. Matthews be & he is hereby appointed guardian of the persons & property of Jane E. and William Bryant minors & orphan children of William Bryant late of Burke County deceased on his giving bond with security in the sum of six thousand dollars whereupon the said Charles L. Matthews gave Z. L. Fryer for security in the bond dictated by the Court & was qualified in terms of the law PAGE 168 It being made apparent satisfactorily to this court that Selina H. Bryant administrator of the estate of William Bryant late of Burkes County deceased has said the receiving said office of administratrix interemade [?] with Charles S. Matthews. It is therefore ordered that said Charles S. Matthews be & he is hereby appointed administrator in right of his said wife Selina H. Bryant alias Selina H. Matthews on his giving bond & security in the sum of three thousand dollars, whereupon he executed the bond by giving Z. L. Akins admr of the estate of Phillip Jackson late of said County deceased that he had in terms of the law published his notice that he would apply to this court for an order to sell all the land & Negroes of said estate & no objection having been filed in clerks office It is therefore ordered that he be & he is hereby authorized to sell all the land & Negroes of said estate ========== Whereas it appears from the application & showing of Thomas L. Pope to said Court that John Shockley late of Monroe County now deceased did [ continued next page] PAGE 169 in his lifetime execute an agreement in writing purporting to be a deed of bargain & sale unto the said Thomas L. Pope his heirs & assigns to one half of lot of land number 212 in the 5th dist. of Monroe County & said State. And it appearing that said written agreement or deed of bargain & sale is perfect in all respects except that of having the names of attending witnesses subscribed thereto & that William Brown of said county is the administrator of the estate of the said John Shockley deceased It is therefore ordered by this Court that the said William Brown admr as aforesaid show cause if any he have at the next Term of this Court why this Court should not pass an order absolute for such persons as are & were acquainted with the said John Shockleys hand writing in his lifetime to attest said written agreement or deed of bargain & sale as such And it is further ordered by the Court that the said Thomas L. Pope do now deposit with the clerk of said Court the aforesaid written agreement or deed of bargain & sale & that the same with him remain for the inspection & examination of all persons interested or concerned until the next term of this Court & that the sheriff of said County or his deputy do serve a copy of this rule on the said William Brown admr as aforesaid twenty days before the next Term of said Court PAGE 170 It appearing to the Court that Francis S. Martin has been called on by a rule Nisi issuing out of this Court to show cause at the present Term why his letters of Guardianship of the person & property of Bethia Muckleroy alias Bethia Andrews an infant under the age of twenty one years should not be revoked. And it appearing to the Court that no sufficient cause having been shown. It is therefore ordered by the [ _ ] the said letters of guardianship be considered & adjudged revoked on the grounds that the Court granting the letters of guardianship had no jurisdiction over the infant at the time of their issuing being out of the county of Pike & State of Georgia ========= Whereas it appears to this Court that William Simmons, Robert Allen, John Grisham, Young D. Allen Senr. & William M. Bethune esqrs have in obedience to the order passed by this Court at the last term of this court made a division of the estate of Samuel M. Sneed dec’d It is therefore ordered that the return of the aforesaid partitioners [sp] be confined & become the Judgment of this court Ordered that Wm J. Ellis be & he is hereby appointed guardian of the persons & property of Dudley, Elizabeth Ann, Leroy [?] & Sarah Ann Sneed orphan children of Samuel M. Sneed dec’d on his giving bond & security in the sum of eight thousand dollars whereupon he executed the bond by giving Wm Ellis for security in a [ _ ] & was qualified in terms of the law PAGE 171 It appearing to said Court that Green Reid of Meriwether County & said State is the reputed father of a bastard child of which Susan M. [?] Brown has been delivered & it also appearing to said Court that the said Green Reid as principal & one Lewis P. Eaves as security has heretofore given bond according to law to guarantee the Justices of the Inferior Court, inhabitants of said County against the charge & trouble of the carying in of the said Susan M. and the maintenance & trouble of the aforesaid bastard child And it is also further appearing to said Court that the said Green & Lewis P. have made [ _ ] of said Bastardy bond. It is therefore ordered by the Court that suit be brought by the Justices of said Court against the obligation[?] of said Bastardy bond. And it is further ordered by the Court that Allen W. Prior Esqr be appointed by said Court as their attorney to being said ======== It is ordered by the Court that William J. Ellis guardian of the persons or property of the minors of Samuel M. Sneed dec’d be authorized to hire the Negroes & rent the land belonging to said minors privately exercising a sound discretion in so doing ========= Ordered that the Sheriff procure a small log chain & large steeple together with good & sufficient hand cuffs to be used for the safe keeping of William Porter who is now confined in jail for the crime of stabbing PAGE 172 [ following marked out] The Court adjourned until Tuesday the [ _ ] this 3rd July 1838 J. Williamson Chair PAGE 174 The Inferior Court of Pike County Sitting as a Court of Ordinary met pursuant to adjournment this 3rd day of Sept 1838 It appearing to the Court that a rule Nisi having been attained at the last term of this Court stating that John Shockley late of Monroe County dec’d in his lifetime executed an agreement in writing purporting to be a deed of bargain & law unto one Thomas L. Pope his heirs and assigns to one half of Lot of land number 212 in the 5th dist. of Monroe County & said State. And that said written agreement or deed of bargain & sale is perfect in all aspects except that of having attesting witnesses [ _ ] thereto & that William Brown of said County in the administrator of said estate & calling on William Brown admr as aforesaid to show cause if any he have at the present term of the Court why this court should not pass an order absolute for such persons as are & were acquainted with said Shockleys hand writing in his lifetime to attest said written agreement or bargain & [ _ ] show at this term no cause being shown to the contrary and no objection being made by the said William Brown admr as aforesaid & any other person in interest & it is on motion ordered that said ruling be made absolute & that said Thomas L. Pope be permitted to get some two or more persons who were acquainted with the said John Shockleys hand writing to attest said deed and that it be considered perfect William Harris JJC John H. Of Monroe now Pike County and no objection having been made of filed at clerks office. Jones, that he had in terms of the law published his notice that he should apply to this Court for an order for dismission from the guardianship. Adkins guardian as aforesaid be & he is hereby dismissed from said guardianship ========= Ordered that Wm M. It is therefore ordered that he be & he is hereby authorized to sell said real estate & so many of the Negroes as will pay said debts It appearing to the Court on the showing of Robert Allen & Mary Hester admr & admix of the estate of Wyatt Hester late of said County deceased that they had in terms of the law published their notice that they would apply to this Court for an order to sell all the lands & Negroes belonging to said Estate. And it further appearing to the Court that no objection had been made or filed in the clerks office of said Court. Blackburn for security & was qualified in terms of the law It appearing to the Court on the showing of Gideon Barnes Execr. Of the Estate of John Crawford deceased that he had published his notice in terms of the law that he would apply to this Court for an order to sell all the lands of said estate & one Negro man by the name of Harry belonging to said estate & it further appearing that no objections had been made or filed in the clerks office of this court. It is therefore ordered that said Gideon Barnes admr aforesaid be & he is hereby authorized to sell all the lands & Negro man above named for the benefit of the creditors & legates of said estate Ordered that Burwell Orr be & he is hereby appointed guardian of the person & property of Francis B. Miller late of Said County deceased petitions this Court to be released from their securityship It is therefore ordered by the Court that Said John M. G. Miller admr as aforesaid do at the next Term of this Court to be held on the first Monday in January next, give other good and sufficient security or his letters of administration will be revoked & it is further that a copy of this order be served at least twenty days before said Court on said John M. G. Miller admr as aforesaid Ordered that L. A. Coppedge & J.W. Coppedge be & they are hereby appointed administrators of the Estate of C. R. Matthews admr of the estate of [blank space] Bryant late of Burke County deceased, that he had in terms of the law published his notice that he would apply to this Court for an order to sell all the land & Negroes of said Estate & it further appearing to this Court that no objection had been made or filed in clerks office of this Court.
