Mangham chairman 5th Day 1830 Court of Ordinary met pursuant to adjournment Present their Honors Jno. C. Mangham James [ _ ] Lewis Daniel Ordered that Bethany Head be & is hereby appointed administratix of the estate of Thomas L. Head late of Merriwether County deceased - on her giving bond & security in the sum of five hundred dollars whereupon she executed the bond directed by the Court was qualified in terms of the Law & received letters of Administration & warrant of appraisement was issued to Jacob Gilder, James Head, Daniel B. Head, Jno. [ _ ] & Isaac Morris Esqrs ========== Ordered that John A. Hartsfield be & is hereby appointed guardian of Richard Hale orphan of John Hale (late of Warren County dec’d) on his giving bond & security in the sum of two hundred dollars - whereupon said Hartsfield executed the bond directed by the court, was qualified & received letters of guardianship in the premises A Rule Nisi having issued against James McMickle, William McMickle & Mariah Martin admrs & admix on the estate of William W. Martin dec’d & James Daniel & Sim [?] R. Bullard their security on this bond & the said rule having been regularly served to the parties; PAGE 10 Court of Ordinary January Term 1830 And they having failed to give any other or further security agreeable to Law. It is therefore on [ _ ] ordered, that the said Administrators & administratix, be discharged from the further administration on the estate of said William W. Martin in [ _ ] & that their said letters of administration be & the same are hereby revolked The court then adjourned till 10 o’clock AM on the 11th next Jno. C. Mangham chairman Pike Inferior Court setting for Ordinary purposes met pursuant to adjournment this 11th day 1830 Present their honors John C. Mangham Lewis Daniel James Lousey & A. T. Camp George Hamil & Anderton Stafford having brought into court the last will & testament of Mary Hinsey alias Hingson & having made the necessary proof thereof by all the sibscribing witnesses to the same & witnesses having been introduced & council heard on the caveat [ _ ] by William Reeves. It is adjudged by the court that said will of Mary Hinsey alias Hingson be admitted to probate & placed upon record as a will for personal & real estate; & that letters Testamentary do issue to the said George Hamil & Anderton Stafford as executors of the aforesaid will. The petition of John Leak knoweth that James R. Gray did on the twenty first day of October eighteen hundred and twenty six, make his certain Bond or writing obligatory and or seal to your petitioner for the sum of three hundred dollars conditioned to make titles to your petitioner to Lot of Land number nine hundred & fifty eight in the ninth district PAGE 11 Court of Ordinary January 1830 of originally Monroe (now Pike County) and the saith James R. Gray having departed this life intestate [sp] without making letters to said tract of land to you petitioner. It is therefore ordered that the legal representation of the said James R. Gray deceased show cause the time prescribed by law, why they should not be directed to make title to the applicant, agreeable to said bond. And it is further ordered that a copy of this rule be published in some publick [sp] Gazette of this State for three months previous to the time titles will be directed to be made. Camp & Matthew Orr Justices Ordered that Thoms W. O’Neal be appointed admr of the estate of Wm. W. Martin deceased, on his giving bond & security in the sum of twenty thousand dollars whereupon he gave bond & security in the amount as directed by the court, was qualified & letters of administration was granted him The court adjourned till Saturday the 6th next A. Mangham Lewis Danie & Matthew Orr Justices Ordered that Letters of Administration on the estate of Nathan Baker be granted to Tabitha Baker & James H. Christian on their giving bond & security in a bond of eight thousand dollars - when William Towels & Seaborn B. Gray became their security in the bond directed by the court, was qualified in terms of the Law & Letters issued accordingly ========== Ordered that Letters of Guardianship be granted to James L. Winfield of the person and property of William D. Gooch orphan of Nathan Gooch deceased on his giving bond & security in the sum of thirteen hundred dollars when John Jenkins became his security in the bond directed by the court, was qualified in terms of the Law & letters issued accordingly. ========== Agreeable to the order of the last court, George W. Hamil (executor of the estate of Mary H. Hinsey alias Hingson) appeared in open court was qualified in terms of the law & letters Testamentary issued accordingly ========== Ordered that Letters of Guardianship be granted to Simon Slade of the person & property of Martha Finney orphan of Arthur Finney deceased on his giving bond & security in the sum of one thousand dollars when he gave Major Harris for security PAGE 13 in the bond directed by the court, was qualified in terms of the law & letters issued accordingly. Ellis admr was examined & approved ========= Ordered that Letters of guardianship be granted to William Finney of the person & property of Eliza Finney orphan of Arthur Finney deceased on his giving bond & security in the sum of twelve hundred dollars when Major Harris became his security in the bond directed by the court, was qualified in terms of the law & letters issued accordingly ========== The return of the sale of lands made by Clary [?] Hambrick admix was examined & approved ========== The return of James Whatley guardian was examined & approved by the court ========== The return of Seaborn B. Gray admr was examined & approved PAGE 14 Court of Ordinary May Term 1830 Elizabeth Phillips admix of the estate of Jonathan Phillips late of said County deceased having made application to this court for a division of the stock of cattle remaining on hand; it is therefore on motion of said administrator, ordered that said remaining stock of cattle be gathered together & divided according to law, between the distributees of said estate & for that purpose Benjamin Tower, Charles Sales [?] , Thomas McClendon, Jesse Adams & James Lee are hereby appointed to make said division of said stock according to law & to assign each distributee his or her part & to make their return of the same to this court. ========== Application having been made to this court by Major Harris Admr for the estate of Arthur Finney late of Jones County deceased for leave to sell lot of land number seventeen in the fifteenth district of originally Carroll now Troup County & the said Administrator having regularly published in a public Gazette his four months notice of his intended application. It is therefore Ordered that said administrator have leave to sell said tract of land for the benefit of the heirs & creditors of said estate. ========== Ordered that Wiley M. Brooks receive letters of Guardianship of the persons & property of [ _ ] [ _ ] & Eliza Brooks orphans & minor children of Samuel Brooks late of Baldwin County deceased on his giving bond & security in the sum of twenty five hundred dollars - when Jacob McClendon & David Maddin[?] became his security in the bond directed by the court, was qualified in terms of the Law & letters of Guardianship issued accordingly The court adjourned till court in course John C. Mangham JJC Chairman PAGE 15 Court of Ordinary July Term 1830 Inferior Court setting for Ordinary Purposes met July Term 1830 Present their Honors John C. Mangham Lewis Daniel & A. T. Camp Justices Ordered that William V. White & John Smith executors of Moses Smith late of Said county deceased be & they are hereby authorized to sell all the real & personal estate of said deceased for the benefit of it if the creditors & heirs of Said deceased ========== Whereas John Leak has petitioned Said Court of Ordinary for an order to cause the administrators ofJames R. Gray deceased to make titles to acertain tracts of land know & distinguished by no.(158) one hundred & fifty eight in the ninth district of originally Monroe now Pike County & whereas said petition has been published in terms of the law. It is therefore ordered by the Court that Seaborn B. Gray admr & Elizabeth C. Gray admix of said estate do & they are hereby required to make fee simple letters for said tract of land to said John Leak ========== The petition of Wiley Mangham showed that James R. Gray did on the thirteenth day of October eighteen hundred & twenty three, make his certain bond or writing [ _ ] under seal to give petitioner for the sum of eight hundred dollars conditioned to make titles to your petitioner to lot of Land number one hundred & two in the ninth district of originally Monroe now Pike County - And the said James R. Gray having departed this life in testate without making titles to said tract of Land to your petitioner. PAGE 16 It is therefore Ordered that the legal representative of the said James R. Gray deceased show cause within the time prescribed by law, why they should not be directed to make titles to the applicant agreeable to said bond And it is further Ordered that a copy of the rule be published in some public gazette of this State for three months previous to the time titles will be directed to be made Whereas at the adjourned Court in December it was not convenient for Mrs. Benetta [?] C. Johnson to attend and qualify as administratix of John Johnson deceased and at this term she in person prays to have her name inserted in the bond & letters & to be qualified - it is therefore Ordained that her name be inserted in the letter, whereupon she signed the bond & was qualified in the terms of the law ========== [The following entry was marked out] Ordered that Benetta C. Johnson be & she is hereby appointed guardian of Cicero M., John B. & William W Arnold orphans of William W. Arnold late of Oglethorpe County deceased on her giving bond & security in the sum of six thousand dollars - whereupon she executed the bond directed by the court & was qualified in terms of the law. ========== Ordered that Letters of Administration be granted to James Griffin on the estate of Blaney[?] Griffin deceased on his giving bond & security in the sum of two thousand dollars - whereupon he PAGE 17 executed the bond directed by the court & was qualified in terms of the Law [ The following entry was marked out] The court then adjourned to Thursday the 15th next John C. Mangham JJC Chairman Benetta C. Johnson wife of John Johnson deceased and material guardian of Cicero M. John B. & William W. Arnold orphans of Wm. W. Arnold late of Oglethorpe County under the age of fourteen; presented an exemplification of the records from the court of Ordinary of Jasper County of bond the proceedings had in that court relative to her designation [ _ ] guardianship of said orphans and saying that the same be received & entered upon the records of this court: that she may be appointed guardian of said orphans & be allowed to make her returns in the proceedings to this court. Whereupon the court after examining said exemplification & certificate Ordered that the same be received & entered of record. She hereby appointed guardian of said orphans on her giving bond & security in the sum of Six thousand dollars & that she permitted in future to make returns on said estate to this court - whereupon she executed the bond directed by the court in the sum of six thousand dollars with Willis J. Milner & Jonas Shivers for security & was qualified in terms of the Law The court then adjourned to Thursday the 15th John C. Camp Justices Andrew Battle PAGE 18 Ordered that Wiley M. Brooks guardian of the orphans of Samuel Brooks dec’d. be & hereby authorized to sell Lot of land no (131) one hundred & thirty one in the third district of Coweta County sold for the benefit of said orphans The court then adjourned till court in course John C. Mangahm JJC & chairman PAGE 19 Zebulon September Term 1830 The Inferior Court setting for Ordinary purposes met pursuant to adjournment this 1st Sept 1830 Presents their Honors Andrew Battle A. T. Camp & Justices Matthew Orr Bethany Head came into court & made her election by choosing a childs part of her deceased husbands estate ========== Whereas Jane Ledbetter was not at her appointment of guardianship ( at Jay. Term 1829) of her children qualified by the clerk of this court agreeable to Law. It is therefore ordered that she be now qualified as guardian for her children Fredrick, Jacob, Salina, Andrew J. & Adeline T. Ledbetter orphans of Joseph Ledbetter dec’d which was done in open court. ========= Ordered that Fabian Freeny [?] be & is hereby appointed guardian of the person and property of James D. Freeny orphan of Gillah Freeny late of Baldwin county deceased on his giving bond & approved security in the amount of three thousand dollars - whereupon he gave Solomon Pace for security in the bond directed by the court & was qualified in terms of the Law. ========== Ordered that Smallwood P. Allison be & he is hereby appointed guardian of the person & property of A. K. Allison minor son of James Allison of Talbot County on his giving bond & security in the sum of two hundred dollars whereupon he gave for security James Roddin in the bond directed by the Court & was qualified in terms of the Law PAGE 20 ========== Whereas the trustee of the Poor School Fund for Pike County having resigned - It is therefore Ordered that Solomon Pace be & he is thereby appointed Trustee as aforesaid he having signified his acceptance thereof in open court - Whereupon the following oath was administrated to him Georgia Pike County I Solomon Pace do solemnly swear that I will faithfully perform & discharge the duties of Trustee of the Poor School Fund for the County of Pike as the Law directs: that I will not nor shall any [ _ ] for me or themselves by or with my consent or knowledge, use any money coming into my hands as trustee aforesaid, for my own or their personal use. So help me God Solomon Pace Sworn to & subscribed to in open court this 6th September 1830 H. G. Johnson C.C.O. The Court then adjourned till Court in course Andrew Battle JJC Chairman PAGE 21 The Inferior Court Setting for Ordinary purposes met pursuant to adjournment this 1st of Nov. 1830 Present their Honors A. T. Camp Matthew Orr Justices Lewis Daniel Ordered that Jesse B. Reeves [ “be and” marked thru] guardian of the orphans of John G. Towns late of Jasper County dec’d be & he is hereby authorized to sell lot of land no(52) fifty two in the eleventh district of Carroll County for the benefit of said orphans ========== The petition of Henry J. Bailey respectfully showed unto your honors that Benjamin Gachet late of Pike County executed & delivered unto one John Hale his bond or obligation with his own name thereunto subscribed whereby in said bond or obligation he the said Gachet obligated & bound himself to execute substantial & lawful titles to a lot of land known & distinguished by lot number two hundred & six containing two hundred two & a half acres and lying in the third district of originally Monroe County - It is therefore on motion Ordered that Thomas Stubbs, James Gachet & Caroline Matilda Gachet Exers of the said Benjamin dec’d do execute titles as the representatives and executors of the said Gachet - unto Henry J. Bailey the assignee of said Bond or writing obligatory or show cause to the contrary According to the force of the statute in such case made & provided & the proceedings in this behalf be advertised in one of the public gazettes of this State requiring the executors & executrix of said Benjamin Gachet dec’d to appear & PAGE 22 show cause why said titles should not be executed Georgia Pike County We the undersigned distributes have provided agreeable to the order of the 7th Dec 1829 to divide the estate of Arthur Finney dec’d & have assigned William H. Finney a Negro man Charles valued at 450$ - to Elijah Finney a Negro woman Phebe at 190$ - to Edward Finney a Negro boy Shin at 475$ - to Martha Finney a Negro girl Harriet at 325$ & to Simon Slade a Negro girl Mariah at 375$ - given under our hands this 10th December 1829 Thomas G. Shehee W. F. Williams Wyatt T. Heard I do certify that the within named persons were duly qualified this 10th Dec 1829 J. Mays JP To the Honorable the Court of Ordinary of Pike County, whereas I the security for the administratorship on the estate of Lea Porter deceased have become [ _ ] & wishing to have charges [ _ ] the following reasons First that she has not conducted the business according to Law & that she is likely to remove 1st Nov 1830 Whereupon it is ordered that Sarah Porter admix on the estate of Lea Porter be subpoenaed to appear at the next court for the purpose of giving security in the place of John Isom who has petitioned to be released from any further responsibility PAGE 23 The court then adjourned till court in course this 1st Nov 1830 Jno.
