Camp It appearing to the court that James R. Gray did during his lifetime; execute his certain Bonds to your petitioner (Wiley Mangham) bearing date the thirteenth day of October 1823 In the penalty of eight hundred dollars, to make titles to your petitioner to lot of land numbers one & two in the 9th district of originally Monroe now Pike County and whereas your petitioner has filed in the office of the clerk of this court the original & has regularly published his rule calling on the legal representatives of the estate of said James R. Gray to show cause, if any they have, why they should not be directed by an order of this court, to make titles to your petitioner according to law; and no cause having been shown and your petitioner having paid to the said legal representatives the purchase money for said tract of land: It is therefore ordered by the court, that Seaborn B. Gray & Elizabeth C. Gray the legal administrators of the said James R. Gray do make and execute legal titles to the said Wiley Mangham to said lot of land agreeable to the bond filed in the office of this court according to the statute in such cause made & provided PAGE 24 Zebulon Jay Term 1831 Ordered that the returns of Robert Westmoreland admr of the estate of Jno. H. Gilmon [?] deceased be received & recorded accordingly ========== The petition of Thomas Hardy showed that Blainy Griffin did during his lifetime, execute his certain [ _ ] Bond to your petitioner in the sum of two thousand dollars, with condition to be [ _ ] whenever the said Blainy Griffin should make legal titles to your petitioner to lot of land [ _ ] two hundred & forty five in the third district of Troup County - And whereas the said Blainy Griffin after the making of said Bond ( a copy of which is filed in the office of this court) departed this life without making titles to said lot of land or as provided therefore by will - It is therefore Ordered by this court that the heirs & legal administrators of the said Blainy Griffin, file their objections if any they have why the administrator of the estate of the said Blainy Griffin should not be directed after the expiration of the month from this publication to make titles to your petitioner to said lands agreeable to said bond. And it is further ordered that a copy of the rule be published in some public Gazette for three months previous to the time that letters will be directed to be made ========== Ordered that Issac Cooper, William J. Mangham Andrew Battle Lewis Daniel Justices Matthew Orr Ordered that Arthur T. Camp be & is hereby appointed administrator of the estate of John Pitman deceased on his giving bond & security in the sum of three thousand dollars, whereupon he executed the bond directed by the Court by giving [ _ ] & Spencer Stamper & Zephaniah Cawley, [ _ ] Stamper, Jno. P. Houslee [?], Michael Howard & Hiram T. Gill was appointed the appraisers & said Camp was qualified admr in terms of the Law PAGE 28 Adjourned Court 23rd March 1831 Ordered that Joel Calloway, Michael Howard, Jno. P. Houslee, Daniel Ship time & Benjamin Bryant they be & are hereby appointed distributees of the perishable property of the estate of Jno. G. Towns deceased so far as to assign unto Jessee B. Reeves his distributive share of said perishable property ========== It appearing to this Court that Benjamin Gachett did in his lifetime execute his certain bond to one John Hale whereby he the said Benjamin Gachett obligated himself to make substantial & lawful titles to a certain tract of land known & distinguished by lot no (206) two hundred & six in the third district of originally Monroe County; and it further appearing unto this court that Henry J. Bailey the assignee of said bond or writing obligatory has regularly published his rule calling on the legal representatives of said Gachett to show cause if any they had, why they should not be directed by an order of this court, to make titles to your petition according to Law: and no cause having been shown & your petitioner having paid to the said legal representatives the purchase money for said tract of land. It is therefore Ordered that Thomas Stubbs and Caroline M. Gachett Executor & Executrix of said estate of Benjamin Gachett, do make & execute substantial & careful titles to the said Henry J. Bailey to the said lot of land agreeable to the bond filed in the office of this court & according to the Statute an such case made & approved ========== It appearing to this court that Seaborn B. Gray admr & Elizabeth C. Gray admix of the estate of James R. Gray dec’d has published their notice that they would apply to this court for leave to sell lots of lands PAGE 29 No (221 )two hundred & twenty one in the eighth district of originally Monroe now Pike County & that said notice has been published in terms of the Statute in such cases made and provided It is therefore Ordered that they have leave to sell said tract of land The court then adjourned till court in course Jno. Camp Ordered that Letters of Administration be granted to Jacob W. Andrews & [ _ ] A. Andrews on the estate of Wyatt T. Andrews deceased on their giving bond & security in the sum of seven thousand dollars, whereupon they executed the bond directed by the Court & gave Lemuel Atkinson & Jas. S. Brown for security and warrant of appraisement issued to Thos. R. Brown, Daniel Shuptine, Michael Howard, Thos. G. Philips and Joseph Goddard & they were qualified in terms of the Law Jas. Germany & Wm. C Germany having brought into court the last will & testament of Robert Germany & having made the necessary proof thereof by Jonathon Adams one of the subscribing witnesses. It is therefore Ordered that the said Will of Robert Germany be admitted to probate & placed upon record as a [ _ ] for personal & real estate & that letters Testamentary do issue to the said Jas. Germany & William C. Germany as executors of the aforesaid Will & warrant of appraisement was issued to William A. White, Wiley Mangham, Jas. H. Christian, William [ _ ] & [ _ ] Christian, whereupon the executors was qualified in terms of Law It appearing to this court that Clary Hambrick admix of the estate of James Hambrick deceased has in terms of the law published her application for letters of dismission on said estate & this court after examining as satisfied with her PAGE 31 acting & doings. It is therefore ordered that she the said Clary Hambrick be dismissed from the administration of said estate The court then adjourned till court in course Jno. C. Orr Rule Absolute It appearing to the Court that Blainey Griffin did during his lifetime execute his certain Bond to your petitioner Thomas Hardy, bearing date the 4 day of August 1827. In the penalty of two thousand dollars to make titles to your petitioner to lot of land number 245 in the third dist. of Troup County & whereas your petitioner has filed in the office of the clerk of this Court the [ _ ] & has regularly published his rule calling on the legal representatives of the estate of said Blainey Griffin to show cause if any they have why they should not be directed by an order of this Court to make titles to your petitioner according to law & no cause having been shown & your petitioner having paid to the said legal representative the purchase money for said tract of land. It is therefore Ordered by the court, that James Griffin the legal administrator of the said Blainey Griffin do make execute legal titles to the said Thomas Hardy to said lot of land agreeable to the bond filed in the office of this court according to the Statute in such case made & provided Court then adjourned until 9 o’clock on Monday 25th [ _ ] Lewis Daniel JJC Chairman PAGE 33 Court of Ordinary July 25th 1831 Court of Ordinary met pursuant to adjournment this 25th July 1831 Present their honors Jno. Mangham, Lewis Daniel & Andrew Battle Justices Ordered that Wiley Mangham be & is hereby appointed admr of the estate of Solomon Mangham late of Hancock County deceased on his giving bond & security in the sum of three thousand dollars whereupon he executed the bond directed by the Court & gave John Neal & Samuel Mitchell for security. Warrant of appraisement affixed to Lewis Daniel, C. McDowel, R. Bale, B. Daniel & H. Porter Esqr & said W. Mangham was qualified in terms of the Law Ordered that Clement B. Allen be & he is hereby appointed admr of the estate of Martha Allen late of Oglethorpe County deceased on his giving bond & security in the sum of three thousand dollars whereupon he executed the bond directed by the Court & gave Wm. M. Bethune & Jno. Harper for security: Warrant of appraisement affixed to Jno. Harper, Wm. M. Bethune J. B. Williamson, Jno. B. Reid & Jno. Reeves & said Allen was qualified in terms of the Law Asa Edwards guardian of the person & property of the orphans of Jno. Bailey, late of Morgan County deceased came into court & applied for letters dismissing from the further guardianship of said orphans It is therefore ordered, that all persons concerned are hereby required to be & appear at the Nov. Term of this Court, to show cause, if any they have, why he shall not be dismissed from said guardianship PAGE 34 Wiley M. Brooks, guardian of Elhannah Brooks orphan applied for letters of dismission from the further guardianship of said orphan. It is therefore ordered that all persons concerned are hereby required to be & appear at the November Term of this court to show cause, if any they have, why he shall not be dismissed from said guardianship Jno. Camp & Lewis Daniel Justices Ordered that Isaac B. Williamson Alva Wilson Jonathan Baker, John B. Reid & John [ _ ] Esqr. They be & are hereby appointed distributes of the personal estate of Martha Allen late of Oglethorpe County deceased ========= Ordered that Anderson Covington guardian of Nancy & Thomas Covington orphans of Thomas Covington deceased be & he is hereby authorized to sell the real estate of said orphans for their benefit ========= Ordered that Mary Crawford be & she is hereby appointed Guardian of Joseph, Vincent, William & Hannah Crawford orphans of Andrew Crawford late of Abbeville District South Carolina deceased on her giving bond with [ _ ] security in the sum of forty two hundred dollars whereupon she executed the bond as directed by the court & gave for security Andrew & James Crawford & was qualified in terms of the Law Andrew Battle JJC & Chairman Court adjourned till Court in Course H. Mangham, Matthew Orr & Lewis Daniel Justices Young D. Allen Junior having brought into court the last will & testament of Stokes Allen deceased & having made the necessary proof thereof by all the subscribing witnesses to the same & after hearing objections to probate of said will by James H. Reeves[?] it was adjudged by the court that the said will of Stokes Allen deceased, be admitted to probate & placed upon record as a will for personal property & that letters testamentary do issue to said Young D. Allen the executor named in said will. Whereupon said Allen was qualified in terms of the Law & warrant of appraisement issued to Jonathan Baker, Jas.Bush, Jno. Bottoms Jno. Rivers & Jno. B. Reid Esqrs. It appearing the court upon the Showing of Wiley M. Brooks guardian of Elhannah Brooks orphan& that the Rule Nisi granted him by the Court at their adjourned term in July last has been published in terms of the Law, the court proceeded to examine his accounts & returns & finding them correct & [ _ ] It is therefore ordered that the said Wiley M. Brooks be dismissed from the further guardianship of the person & property of said Elhannah Brooks Upon the showing of Clement Y. Allen admr of the estate of Martha Allen deceased that he had given due & legal notice to the legatees of said estate that he should make application to this court for leave to sell the Negroes of said PAGE 38 estate in order [ _ _ _ ] to the distribution of said estate & no objections having been filed It is therefore ordered that the said admr have leave to sell all the Negroes belonging to said estate Jno.
