T. Camp Justices It appearing to the court from the showing of Wiley Mangham admr with the will annexed on the estate of Solomon Mangham late of Hancock County deceased that he had given due & legal notice to the legatees of siad estate, that he should make application to this court for an order to sell the Negroes of said estate in order more effectually to the distribution of said estate among the legatees no objection having been filed. It is therefore Ordered that the said Admr have leave to sell all the Negroes belonging to said estate ========== It being made appear to this court upon the showing of Arthur T. Camp admr of the estate of John Pitman late of said County dec’d. that he had published due & legal notice that he should apply to this court for leave to sell the land and Negroes of said estate in order more effectually to the distribution of said estate & benefit of the creditors & no objection having been filed It is therefore Ordered that the said admr have leave to sell the land & Negroes belonging to said estate ========== It being made appear to this court upon the showing Egbert P. Daniel admr & Sabina G. Daniel admix of the estate of Lunsford Daniel late of said County dec’d that it would be to the interest of said estate for an order to sell one of the Negroes of said estate & no objection being made It is therefore ordered that said admr & admix have leave to sell said Negro PAGE 40 Ordered that Mary Shehee be & is appointed administratrix of the estate of Thomas G. Shehee late of said County deceased on her giving bond and security in the sum of twenty thousand dollars, whereupon she executed the bond directed by the court & gave William F. Williams & William H. Finney for securities & was qualified in terms of the law The return of James L. Winford guardian was received Andrew Battle JJC & Chairman Court adjourned till Monday the 30th PAGE 41 Inferior Court of Pike County Setting for Ordinary purpose met pursuant to adjournment this 30 Jay 1832 Present their Honors Jno. C. Mangham, Andrew Battle, Arthur T. Camp & Lewis Daniel Justices Ordered that Jonathan Baker be & is hereby appointed the admr of the estate of John McDowel late of of said County deceased on his giving bond & security in the sum of Two Thousand dollars whereupon he executed the bond directed by the court & gave Asa Sessions for security & was qualified in terms of the law warrant of appraisement issued to Ahahan D. Wood, Benjamin Fleming, Jas. Thompson, Jno. Rivers & Jas E. Johnson ========= Ordered that Asa Sessions be & is hereby appointed admr of the estate of John M. Daley late of said County dec’d on his giving bond & security in the sum of five hundred dollars, whereupon he executed the bond as directed by the court and gave Jonathan Baker for security & was qualified in terms of the law: Warrant of appraisement issued to James Davis, Benj. Fleming, Miles Parker Jno. River & Jas E. Johnson ========== Ordered that Asa Sessions be & he is hereby appointed admr. Of the estate of Winifred Barfield late of said County deceased on his giving bond & security in the sum of five hundred dollars, whereupon he gave Jonathan Baker for security & was qualified in terms of the Law The court adjourned till Court in course Jno. C. Mangham JJC Chairman PAGE 42 Inferior Court Setting for Ordinary purposes met pursuant to adjournment this 5 March 1832 Present their Honors John C. Mangham, A. Battle & Matthew Orr Justices Ordered that James Johnson be & he is hereby appointed guardian of Mariah Jones a free woman of color & her four children (viz) Catherine, Leroy & Manly & Simon Jones on his giving bond & security in the sum of five hundred dollars whereupon he executed the bond directed by the court & gave H. G. Johnson for security & was qualified & Letters of guardianship granted him accordingly The court then adjourned till Friday the 23rd instant Jno. C Mangham JJC & Chairman 23rd March 1832 The Inferior Court met for Ordinary purposes Present their Honors A. T. Camp Matthew Orr Andrew Battle & Justices Lewis Daniel John Statum brought into court the last will & testament of David Hicks dec’d and made the necessary proof thereof by Wm. V. White & Zacherus S. McKleroy two of the subscribing witnesses. It is therefore ordered that the said will of David Hicks be admitted to probate & placed upon record as a will for personal & real estate & that letters testamentary due issue to the said John Statum executor of the said will, thereupon he was qualified in terms of the law & warrant of appraisement was granted Court adjourned till court in course Andrew Battle JJC & Chairman PAGE 43 23rd March 1832 Inferior Court Setting for Ordinary purposes met pursuant to adjournment. Present their Honors A. T. Camp Matthew Orr Andrew Battle Justices Lewis Daniel Ordered that James Scott be & he is hereby appointed administrator of the estate of Joseph Scott Junior[?] deceased on his giving bond & security in the sum of five hundred dollars - whereupon he gave Andrew Crawford for security - warrant of appraisement was issued & he was qualified in terms of the Law ========== It appearing to this Court upon the showing of Jacob M. Andrews ( admr of the estate of Wyatt T. Andrews dec’d) & Washington Warren that Said Wyatt T. Andrews did during his lifetime sell unto Joseph Herbo of said County & State a certain tract of land in said County of Pike known & distinguished by no 18 in the third district of now Pike County formerly Monroe & that said Wyatt during his lifetime failed to issue titles or give a bond for the titles to said Herbo of said half tract of land It was therefore ordered that the admr & admix of said Wyatt T. Andrews be & they are hereby required to make titles for said half tract of land to said Joseph Herbo PAGE 44 The Court then adjourned till court in course Andrew Battle JJC & Chairman H. G. Johnson CCO Inferior Court Setting for Ordinary purposes met pursuant to adjournment this 7th May 1832. Present their Honors Andrew Battle, Lewis Daniel, A. T. Camp & Jno. C. Mangham Justices Rule Absolut It appearing to the court upon the showing of Asa Edwards guardian of William & Evelyn Bailey orphans of John Bailey late of Morgan County deceased, that the Rule Nisi granted him by this court at the adjourned term in July 1831 has been published in terms of the Law, the court proceeded to examine the [ _ ] and returns & finding them correct & just. It is therefore ordered that the said Asa Edwards be dismissed from the further guardianship of the persons & property of the said William & Evelyn Bailey Rule Nisi Wiley M. Brooks guardian of the orphans of Samuel Brooks (late of Baldwin County deceased) apply to be dismissed from the further guardianship of the said orphans [ at bottom of page] and at the same PAGE 45 The next entry was marked thru] Time Asa Edwards guardian of the orphans of John Bailey, late of Morgan County deceased came into court & applied for dismission from the further guardianship of said Orphans [end of mark thru] And whereas John H. Hartsfield applied to be discharged from the further guardianship of Richard Hale orphan of John Hale late of Warren County It is thereupon Ordered that all persons concerned are hereby required to be & appear at the July Term of Said Court to show cause, if any they can, why the above named applicant shall not be dismissed from the further guardianship of their wards The Court adjourned till Court in Course Jno. C. Mangham JJC & Chairman PAGE 46 Court of Ordinary (this 2nd) July Term 1832 Present their Honors John C. Mangham Andrew Battle & Arthur T. Camp Justices It appearing to this Court upon the showing of Young D. Allen Junior executor of Stokes Allen dec’d that he had in terms of the Law published his notice that he should apply to this Court for an order to sell the real estate of his testator in order to a Just distribution among the legatees & no objections having been filed or rendered as to this court. It is therefore Ordered that said Young D. Allen Junior executor as aforesaid that he be & he is hereby authorized to sell all the real estate of his testator except the [ _ ] allowed to the widow It appearing to the court upon the showing of John H. Hartsfield, guardian of Richard Hale orphan of John Hale both of Warren County deceased that his rule nisi granted him by the court at their last term has [cont. on p.47] PAGE 47 Been published in terms of the Law. The Court proceeded to examine his returns & finding them correct & just. It is therefore Ordered that the said John H. Hartsfield be forthwith discharged from the further guardianship of the person & property of Said Richard Hale The Court then adjourned till Court in Course John C. Mangham JJC Chairman PAGE 48 Inferior Court Setting for Ordinary purposes met pursuant to adjournment this 3rd Sep 1832 Present their Honors Andrew Battle A. T. Camp & Justices L. Daniel Ordered that Joseph Fincher be & he is hereby appointed admr of the estate of David W. Story late of said County deceased on his giving bond & security in the sum of twelve hundred dollars. Whereupon he executed the bond as directed by the court & gave Hugh Millican for security & was qualified in terms of the law ========== Ordered that Joseph Goddard & E. Matthews be & they are hereby appointed admr & admix of the estate of Enoch Matthews late of said county deceased on their giving bond & security in the sum of sixteen hundred dollars Whereupon they executed the bond as directed by the court & gave Irbi Stamper & Michael Howard for security & was qualified in terms of the Law ========== Ordered that Cader Carter be & he is hereby appointed guardian of the person & property of James B. Carter illegitimate child of Mahala Carter on his giving bond & security in the sum of four hundred dollars whereupon he gave James Reas for security as directed by the court & was qualified in terms of the Law PAGE 49 Rule Nisi Reuben Westmoreland guardian of the person & property of Pamela Ann Hale orphan of John Hale late of Jones County deceased applied to be dismissed from the further guardianship of said orphan It is therefore ordered that all persons concerned are hereby required to be & appear at the November Term of Said Court, to show cause if any they can, why he shall not be dismissed from the further guardianship of said orphan The Court then adjourned till Court in Course Andrew Battle Chairman Inferior Court Setting for Ordinary purposes met pursuant to adjournment this 5th Nov. 1832 Present their Honors John C. Mangham A. T. Camp Matthew Orr Justices Lewis Daniel The return of S. B. Gray admr of the estate of Jas. R. Gray deceased, exhibited his return for 1831 to the Court, which was examined and approved of by the Court & ordered to be recorded PAGE 50 Mary Crawford Guardian exhibited her return for 1831: which was examined & approved of & ordered to be recorded ========== Reuben Westmoreland (guardian of Pamela Ann Hale orphan of John Hale late of Jones County deceased) having made it appear to the satisfaction of this Court that the Rule Nisi for demission granted him at the last term of the Court had been published in term of the Law & the Court on examining his returns found them just & correct. It is therefore Ordered that the Said Reuben Westmoreland be forthwith discharged from the further guardianship of the person & property of the Said Pamela Ann Hale ========== Ordered that Robert Allen & Mary Hester be & they are hereby appointed admr & admix of the estate of Wyatt Hester late of Said County deceased on their giving bond & security in the sum of five thousand dollars, whereas they executed the bond as directed by the Court & was qualified in terms of the Law ========== It appearing to this Court upon the showing of Asa Sessions admr of the estate ofWinifred Barefield deceased, that he had in terms of the law, published his notice that he should apply to this Court for an order to sell all the real estate of the said deceased in order to a just distribution among the legatees & jno objection having been filed or rendered in to this Court It is therefore Ordered that the [cont. on next page] PAGE 51 Said Asa Sessions admr as aforesaid be & he is hereby authorized to sell the real estate of said deceased ========== Ordered that the order appointing James Johnson guardian of Mariah Jones a free woman of color & her four children (viz) Manly, Catherine, Leroy & Simon be & the Said Order is hereby revoked ======== Ordered that Egbert P. Daniel be & he is hereby appointed guardian of Catherine, Manly, Leroy & Simon Jones the children of Mariah Jones a free woman of color on his giving bond & security in the sum of of five hundred dollars whereupon he executd the bond as directed by the court & was qualified in terms of the law ========== It appearing to the court upon the showing of John Neal & James D. Wilson, that John M. Daley did during his lifetime sell unto the said John Neal two certain lots in the town of Zebulon with the improvements thereon; known and distinguished in the town plan by lots (17 & 18) seventeen & eighteen & that said John M. Daley failed to make titles or to give a bond for titles to said Neal for said lots: It further appearing that the legate is willing for the admr of said Daley to make titles & the said John Neal having paid the full amount of money or is willing to pay the balance that may be due [ _ ] titles be executed to him for said lots. It is therefore Ordered [continued on next page] PAGE 52 That Asa Sessions admr of said Daley be & he is hereby required to execute titles for said lots to the said John Neal =========== [following entry marked out] The court then adjourned till court in course this 5th Nov 1832 Ordered that James Scott be & he is hereby appointed guardian of his minor children (viz) Martha, Sarah Ann, Margaret, Patrick and Thomas Scott on his giving bond with approved security in the sum of eight hundred dollars. Whereupon he gave J. R. Culpepper for security in the bond as directed by the court, was qualified in terms of the law and letters of guardianship issued accordingly The court adjourned till court in course John C.
