B. Gray admr & E. C. Gray admix of the estate of Jas. R. Gray dec’d that they had in terms of the law published their notice that they should apply to this court for an order to sell all the real estate of siad dec’d & it further appearing that no objection had been filed or rendered in. It is therefore ordered that said S. B. Gray & E. C. Gray admr & admix as aforesaid be & they are hereby authorized to sell all the real estate of the said dec’d for the benefit of the heirs The Court adjourned till court in course this 6th Jny 1834 John C. Calloway & Justices William Harris It appearing to this court upon the showing of Francis L. Matthews admr of the estate of Isaac Matthews deceased, that due & legal notice had been given to the legatees of siad estate, that he would make application to this court for an order to sell the Negroes of said estate & it further appearing that such sale is necessary for the benefit of the the creditors & heirs & no objection having been made to the granting of such order. It is therefore ordered that the admr be & he is hereby authorized to sell said Negroes ========= Ordered that Alfred Buffington be & he is hereby appointed guardian of the persons & property of Rebecca S. & Phebe Buffington orphans of Jacob Buffington late of Monroe County deceased on his giving bond & security in the sum of eight hundred dollars whereupon he executed the bond as directed by the court & gave H. L. Gill for security & was qualified in terms of the law Court then adjourned till court in course J. B. Williamson JJC & Chairman PAGE 71 Inferior Court of Pike County setting for Ordinary purposes met pursuant to adjournment this 5th May 1834 Present their Honors J. B. Williamson Wm. Harris Justices J. R. Calloway & Lewis Daniel The last will & testament of John Cameron[?] deceased, containing his real as well as personal estate was on the fifth day of May brought into court by Josiah E. Nunnally & John Marshall & the necessary proof thereof being ready by the oath of Ludowick Reas[?] & John Marshall two of the subscribing witnesses. It is therefore ordered that the said will of John Cameron be admitted to probate & placed upon record as a will for personal & real estate & that letters testamentary do issue to the said Josiah E. Nunnally & John Marshall as executors of said will, whereupon the said Josiah E. Nunnally & John Marshall was qualified in terms of the law & warrant of appraisement issued ========== Ordered that Mary P. Griffin & John R. Kindrick be & they are hereby appointed admr & admix of the estate of Anderson Griffin late of said county deceased on their giving bond & security in the sum of eight thousand dollars. Whereupon they executed the bond as directed by the court & were qualified in terms of the law & warrant of appraisement issued PAGE 72 On the showing of Arthur T. Camp Admr of the estate of John Pitman dec’d. that he had in terms of the law published his citation that he should apply to the court for an order of dismission from the administration of said estate & no objection having been filed the court on examination found his acting and doing just & correct. It is therefore ordered that said Arthur T. Camp admr as aforesaid be dismissed from the administration of said estate ========== On the showing of Elizabeth Phillips admix of the estate of Jonathan Phillips deceased that she had in terms of the law published her citation that she would apply to the court for an order of dismission from the administration of said estate, & no objections having been filed, the court on examination found her acting and doing just & correct It is therefore ordered that said Elizabeth Phillips admix as aforesaid be & she is hereby dismissed from the further administration of said estate ========== On the showing of Elizabeth Phillips & James A. T. Phillips guardians of the orphans of Jonathan Phillips dec’d. that they had in terms of the law published their citation that they should apply to this court for an order of dismission from the guardianship of these wards & no objection having been filed the court on examination found their acting & doing just & PAGE 73 correct. It is therefore ordered that said Elizabeth & Jas. A. T. Phillips guardians as aforesaid be & they are hereby dismissed from guardianship of their said wards ========== It appearing to the Court that Isaac Matthews did during his lifetime execute his certain bond to James [ _ Moss] & the said James [ _ ] indorsed the same to your petitioner Alexander Scott for a valuable consideration bearing date the 1st Nov 1831. In the penalty of nine hundred dollars to make titles to the aforesaid [ _ ] to lot of land no. 140 in the nineteenth dist. Of Muscogee County & State aforesaid & whereas your petitioner has filed in the office of the clerk of this court a copy of the original bond & called on the legal representation of the estate of Isaac Matthews deceased to show cause if any they have why he she or they should not be [ _ ] by an order of the court to make titles to your petitioner Alexander Scott according to law ========== Ordered that Arthur T. Camp be & he is hereby appointed guardian of the person & property of [ _ ] Pitman orphan & minor child of John Pitman late of Said County deceased on the giving bond & security in the sum of sixteen hundred dollars. Whereupon he executed the bond as directed by the Court & gave for security Joseph Goddard & was qualified in terms of the Law PAGE 74 Ordered that Irby Stamper be & he is hereby appointed guardian of the person & property of Thomas Pitman orphan & minor child of John Pitman late of said County deceased on his giving bond in the sum of sixteen hundred dollars, whereupon he executed the bond as directed by the Court & was qualified in terms of the law The Court adjourned till Court in Course J. B. Williamson Chairman PAGE 75 Inferior Court Pike County setting for Ordinary purposes this 7th July 1834 Present their Honors Wm. Harris J. B. Williamson & Justices J. R. Calloway It appearing to the Court upon the showing of Asa Edwards guardian of Jeremiah Bailey orphan of John Bailey late of Morgan County deceased that he had in terms of the law had the rules nisi granted him at Amy term 1832 published. The court after examining his acting & doings & finding them correct. It is therefore ordered that said Asa Edwards guardian be & he is hereby dismissed from the further guardianship of the person & property of said Jeremiah Bailey ========== It appearing on the showing of Pitt S. Milner Guardian for his minor child Elisha C. that he had in terms of the law published his notice that he should apply to this court for an order to sell all the real estate of said minor & no objections having been filed & it is therefore ordered that he hereby authorized to sell all the real estate of said minor for said minors benefit ========== Ordered that Josiah [ _ ] be & he is hereby appointed guardian of the person & property of Eliza, Mary, Caroline & Emily Holton minor children of Asa Holton & Eliza Holton on his giving bond & [continued on next page] PAGE 76 security in the sum of four thousand dollars whereupon he executed the bond & gave Charles McDowell for security & was qualified in terms of the law ========== On motion it is ordered by the Court that Diannah Johnson be & she is hereby appointed guardian of her illegitimate infant daughter, not yet named, on her entering into a bond with James E. Johnson & Asa Sessions in a bond of three hundred dollars or person who may be equally good, within twenty days from this time, and on failure to do so then that Pleasant Moorman be appointed guardian on his giving the like good security & that the clerk issue letters of guardianship accordingly The Court adjourned till Court in Cause J. Orr [following marked thru] Ordered that Alfred Buffington guardian of the orphans of Jacob Buffington late of Monroe County deceased be & he is hereby authorized to sell the real estate of said orphan for the benefit of the creditors & said orphans [end of mark thru] ========== It appearing to the court on the showing of Alfred Buffington guardian of the orphans of Jacob Buffington late of Monroe County deceased that he had in terms of the law published his notice that he should apply to this court for leave to sell the real estate of said orphans and no objection having been filed or rendered. It is therefore ordered that he be & he is hereby authorized to sell the real estate for the benefit of said minor orphans ========== It appearing to the court on the showing of Martha Knight guardian of the orphans of Abednego Crawford late of Putnam County deceased, that she had in terms of the law published her notice that she should apply to this Court for an order to sell the real estate of said orphans [continued on next page] PAGE 78 & no objections having been filed or [ _ ]. It is therefore ordered that said Martha Knight guardian as aforesaid be & she is hereby authorized to sell the real estate of said orphans for their benefit ========== It appearing to the Court that Isaac Matthews did during his lifetime execute his certain bond to James Monk[?] whereby he the said Isaac Matthews obligated himself in the penalty of nine hundred dollars to make title goods sufficient to a certain tract of land known & distinguished by lot No (140) one hundred & forty in the nineteenth district of Muscogee County & State of Georgia and it further appearing that Alexander Scott the assignee of Said bond or writing [ _ ] has regularly published his [ __] the legal representative of said Isaac Matthews to show cause is any they had why they should not be directed by an order of the court to make titles to your petitioner according to law & no cause or objection having been filed or rendered in & your petitioner having paid the purchase money for said tract of land It is therefore ordered that Francis L. Matthews the legal representative of said estate of Isaac Matthews do make & execute good & sufficient title to the said Alexander Scott to the said tract of land agreeath To the bond filed in clerks office & according to the statute in such case made as provided PAGE 79 The last will and testament of Nathan Bryant deceased, containing his personal as well as real estate was on the first day of September 1834 brought into court by Little Bryant the executor of said will & the necessary proof thereof being made by the oath of Burrel Green one of the subscribing witnesses - it is therefore ordered that the said will of Nathan Bryant be admitted to probate & placed on record as a will for personal & real estate & that letters testamentary do issue to the said Little Bryant whereupon Little Bryant was qualified as executor Court adjourned to court in course J. B. Williamson Chair PAGE 80 Inferior Court of Pike County Setting for Ordinary purposes met pursuant to adjournment this 3rd Nov. 1834 Present their Honors J. B. Williamson J. R. Calloway & Justices Matthew Orr The last will & testament of James Lowery deceased containing his personal as well as his real estate was on the third day of November 1834 brought into court & the necessary proof thereof being made by the oath of Aza Sessions & Joseph Deason two of the subscribing witnesses, ordered that said will be placed on record as a will for personal & real estate ========== The last will & testament of Tabitha Baker was on third day of November 1834 brought before Wm Harris & Lewis Daniel two justices of the Inferior Court & the necessary proof thereof being made by the oath of Allen W. Prior, John Carswell & Robt. Smith the three subscribing witnesses. It is therefore ordered that said will of Tabitha Baker be admitted to probate & placed on record as a will for personal & real estate. Whereupon James H. Christian & Ransom Christian executors named in said will were qualified in terms of the law Court then adjourned to 1st Monday in December next J. B. Williamson Chair PAGE 81 Inferior Court of Pike County setting for Ordinary purposes met pursuant to adjournment this 1st December 1834 Present their Honors J. B. Williamson Jas. R. Calloway & Justices Matthew Orr Ordered that Tilman Leak & Mary Cunningham be & they are hereby appointed Admr & Admix of the estate of William Cunningham late of Said County deceased on their giving bond & security in the sum of eighteen thousand dollars, whereupon they executed the bond as directed by the Court & were qualified in terms of the law & warrant of appraisement was issued to Jno. W. Brown, S. Mitchell, H. Porter J. C. Mangham & M. Martin ========== It appearing to the court that Irby Stamper the security of Hiram T. Gill to whom James Hogan an illegitimate minor was bound wishes to be discharged from further liability as security on said bond. It is ordered that when said Hiram T. Gill shall give other equally as good security, that the said Irby Stamper be discharged from further liability on said bond & [ _ ] [ _ ] which was done J. B. Williamson JJC It appearing to the court on the showing of Josiah Mims admr of the estate of James Mims deceased that he had in terms of the law published his notice that he [ had in terms 0f the - entered twice] should apply to this court for an order to sell the real estate of said deceased & no objections having been filed or rendered in. It is therefore ordered that said Josiah Mims admr. As aforesaid be & he is hereby authorized to sell said real estate for the benefit of the heirs Court adjourned till Court in course J. B.
