B. Williamson J. L. Blackburn Wm. Harris & Justices Matthew Orr It appearing to the Court upon the showing of Jno. N. Kindrick admr & Mary P. Griffin admix of the estate of Anderson Griffin deceased that it will be to the interest of the heirs of said estate as well as to a more just distribution of said estate among the heirs, that two of the Negroes be sold. It is therefore ordered that the admr & admix be & they are hereby authorized to sell Sambo a Negro man & Randall[?] a boy for the benefit of the heirs & creditors of said estate ========== Ordered that Asa Sessions be & he is hereby appointed Administrator of the estate of James Lowery late of said county deceased on his giving bond & security in the sum of three thousand dollars, whereupon he executed the bond as directed by the court & gave Joseph Deason for security, when he was qualified in terms of the law & warrant of appraisement issued to W. M. Bethune Jacob J. Gilder [ _ _ _ ] ========= Ordered that Egbert P. Daniel be & he is hereby appointed guardian of the person & property of Joseph H Daniel orphan of Lunsford R. Daniel of said county deceased on his giving bond & security in the sum of three thousand dollars [continued on next page] PAGE 83 Whereupon he gave John Hale & Jonathan Adams for security & was qualified in terms of the law ========== Ordered that Charles McDowell, John B. Reid A. W. Prior, John C. Mangham & H. Stokes be & they are hereby appointed distributees of the personal estate Lunsford R. Daniel of said county deceased ========== Charles McDowell admr & Eleanor Jones admix of the estate of Joseph Jones late of Heard County deceased presented an exemplification of the record from the Court of Ordinary of Heard County of the proceedings had in that court relative to said administration duly certified by C. C. O. of said court & praying that the same may be received & entered upon the record of this court & that they may be allowed for the future to make their return in the premises to this court. Whereupon the court after examining the exemplification & certificate Ordered that the same be received & entered upon the record of this court & that said admr & admix be permitted in future to make their returns on said estate to this court they first executing a bond to this court in the sum of eight thousand five hundred dollars in terms of the law for the faithful administration of said estate with Robert Allen & Leonard Worthy for security The petition of James Henly [?] showith that James R. Gray during his lifetime made and executed his bond to your petitioner made a [continued on next page] PAGE 84 certain penalty to execute title to your petitioner to a lot of land number (29) twenty in the fifteenth district of originally Monroe now Pike County & whereas the said Gray died interstate without executing titles to said lot of land, and the said James Henly being now ready to pay the purchase money. It is therefore ordered by the court that Seaborn B. Gray & Elizabeth C. Gray administrators of the estate of the said James R. Gray do execute titles to said lot of land to the said James Henly or the bearer of said bond. It appearing to said court that Jacob Levings has bound himself [himself - double entry] by writing to make good & lawful titles unto William Cunningham to lot of land number twenty eight in the ninth district of the second section which lot was drawn by said Levings. It appearing to the court that Henry C. Sills[?] has bound himself by writing to make good & lawful titles unto Tilman Leak to lot of land number two hundred & sixty three in the eleventh district of the second section in the Cherokee purchase It appearing to the court that the said Tilman Leak has endorsed & transferred in writing the said writing made to him by the said Sills unto William Cunningham for value received; and it appearing to the court that William Cunningham ( since the making and endorsing the said writing) has died possessed of said writing; It is therefore ordered by the court that titles to the land aforesaid be made to the heirs general [?] of William Cunningham deceased PAGE 85 The court proceeded to the election of a clerk for said court for the ensuing two years, where on counting out the votes Hugh G. Johnson CCO PAGE 86 March Term 1835 Inferior Court Pike County Sitting for Ordinary purposes met pursuant to adjournment this 2nd March 1835 Present their Honors J. B. Williamson Jno. L. Blackburn Matthew Orr & Justices J. B. Reid Ordered that Beverly Daniel be & he is hereby appointed Administrator of the estate of Herod Reese late of said county deceased, on his giving bond & security in the sum of one thousand dollars whereupon he executed the bond as directed by the court & gave for security Samuel Mitchell & was qualified in terms of the law & warrant of appraisement issued to Wm V. White, E. Head, Stephen Williams, James Dismukes & E. B. Brown ======== The last will & testament of John R. Brown deceased was brought into court & the necessary proof thereof being made by the oath of Henry Smith & Wm. R. Jones & Jno. B. Jones the three subscribing witnesses to said will. It is therefore ordered that said will of John R. Brown be admitted to probate & placed on record as a will for personal & real estate. Whereupon Willis J. Milner & Samuel R. Nutt the executors named in said will were qualified in terms of the law ========= Ordered that John Dorton[?] be & he is hereby appointed Administrator of the estate of Benjamin Dorton late of said county deceased on his giving bond & security in the sum of eight hundred dollars, whereupon he executed the bond as directed by the court & gave John Grantham & E. Gardner for security & was qualified in terms of the law & warrant of appraisement issued to L. Wise [continued on next page] PAGE 87 Thos. G. Phillips, Jno Sessions, J. P. Henslee [sp] & R. Bond ========= Ordered that J. R. Culpepper be & he is hereby appointed guardian of the following named persons of color (viz) Lewis King, blacksmith aged 47: his wife Eliza King Spinster aged 19: their son Green King aged 4 years & John King 2 years old recently from Jasper & formerly of Greens County Georgia on said Culpepper giving Security in a sum of five hundred dollars Ordered that Felix T. Williams be & he is hereby appointed Guardian of the following free persons of color (viz) James [Cousins ?]Blacksmith aged [blank space] his wife Rebecca Spinster aged [blank] & their children Ellis, Anderson, James & Jack aged (12, 6, 3 & 2 ) years, twelve, six, three & two on his giving Security in a bond of five hundred dollars whereupon he executed the bond by giving Zachariah Cauley for Security & was qualified in terms of the law PAGE 88 It appearing to Said Court that Jesse B. Reaves guardian of the orphans of John G. Jones[?] dec’d has duly published his motion that application would be made to this court for leave to sell lot of land No. 236 in the second district of originally Monroe now Pike County for the benefit of Said orphans. It is therefore Ordered by this court upon the application of said Reaves that the said premises be advertised & sold in the manner printer out by law for the purpose aforesaid The court then adjourned until court in course J. Johnson CCO PAGE 89 The Honorable the Inferior Court for the County of Pike Setting for Ordinary purposes met pursuant to adjournment this 4th May 1835 Present their Honors William Harris Isaac B. Williamson John L. Blackburn John B. Reid & Justices James Neal It appearing to the court that Tilman Leake admr & Mary Cunningham admix of the estate of William Cunningham deceased have legally published that application would be made to this court for leave to sell all the real estate belonging to said estate & it appearing to the court that no person interested has filed any objections to an order of court passing to that effect. It is therefore ordered by Said court that leave be granted to Said administrator & administratrix to advertise and sell all the real estate belonging to said William Cunningham dec’d ========== It appearing to the court that Egbert P. Daniel administrator of the estate of L. R. Daniel dec’d has given notice agreeable to law, that application would be made to this court for leave to sell one hundred one and a quarter acres of land situate lying & being in the Second district of originally Monroe now Pike County known & distinguished in the plan of said district by the South half of lot one hundred & fifty four it being all of the real estate of L. R. Daniel dec’d. It appeared to the court that no objection has been filed, It is therefore ordered that leave be granted to said admr to advertise & sell said lot of land PAGE 90 Ordered that Elias J. Braner be & he is hereby appointed administrator of the estate of William S. Williams on his giving bond with approved Security for the sum of four hundred dollars, whereupon he executed the bond as directed by the court & gave [ no name listed] for Security & was qualified in terms of the law =========== It appearing to the court that Francis L. Matthews (admr of the estate of Isaac Matthews deceased) had in terms of the law published his notice that he should apply to this court for leave to sell all the real estate of Said deceased & it further appearing that no objections had been filed, It is therefore ordered that Said Francis L. Matthews admr as aforesaid be & he is hereby authorized to sell one half of lot no (126) one hundred & twenty six in the ninth district of Fayette County & one eighth part of no (20) twenty in the first district of Monroe now Pike County it being the real estate of said Isaac Matthews deceased The Court then adjourned till first Monday in June next 10 oClock AM J. Harris J. L. Blackburn & Justices J. B. Reid Ordered that letters of Guardianship be & they are hereby granted to Elizabeth Ingram of the person & property of Janeyele [?] C. Ingram orphan of James M. Ingram late of Meriwether County dec’d on her giving bond & security in the sum of six hundred dollars, whereupon she executed the bond as directed & gave John Redding & William V. White for security was qualified in terms of the law & letters issued accordingly The court adjourned till 10 oclock AM tomorrow J. B. Williamson JJC Chair Inferior Court sitting for ordinary purposes met pursuant to adjournment this 2nd June 1835 Present their Honors J.B. Williamson William Harris Jno. L. Blackburn & Justices J. B. Reid It appearing to the court upon the showing of Joseph Fincher that citation had been published in terms of the law that he would apply to the court for an order of dismission & it further appearing that no objection had been made or filed with the clerks office & the court having examined his acting & doings & found all correct. It is therefore ordered that he be dismissed from the further administration of said estate PAGE 92 The court [ _ ] then adjourned till court in course this 2nd June 1835 J. B. Williamson JJC & Chair PAGE 93 The Inferior Court of Pike County Sitting for ordinary purposes met this 6th July 1835 Present their Honors J. B. Williamson W. Harris J. L. Blackburn Justices J. B Reid & J. Neal Ordered that Beverly Byram be & he is hereby appointed Administrator of the estate of James Byram Senior late of said County deceased on his giving bond & Security in the sum of eight hundred dollars, whereupon he executed the Bond as directed by the court & gave James H. Reaves[?]for security & warrant of Appraisement M. Lawrence, B. Irvin, Jno. Coggin, Wm. Bowland & Wm. H. Pryor It appearing to the court that Fabian Freeney the security of Pitt S. Milner Guardian of his minor son Elisha C. wishes to be discharged from further liability & security on said bond. It is ordered that said Fabian Freeney be discharged on said Pitt S. Milner, giving other equally as good security, whereupon he gave Charles P. Turner for security in a bond of seventeen hundred dollars The court then adjourned till court in course J. B. L. Blackburn James Neal & Justices Jno. B. Reid It appearing to the court on the showing of Mary P. Griffin Admix & Jno. R. Kindrick admr of the estate of Anderson Griffin deceased that they had in terms of the Law published their notice that they would apply to this court for an order to sell all the real estate of Said deceased & it further appearing that no objection had been filed. It is therefore ordered that said Mary P. Griffin admix & Jno. R. Kindrick admr as aforesaid be & they are hereby authorized to sell all said real estate ========== It appearing to the court on the showing of T. Leak one of the admr of the estate of Wm. Cunningham deceased, that he had in terms of the law published his notice that he would apply to this court for an order to sell the balance of the Negroes of said estate & it appearing there has no objection been filed. It is therefore ordered that said Tilman Leak admr as aforesaid be & he is hereby authorized to sell all the Negroes of said estate PAGE 96 The last will & testament of William Ward deceased was brought into court & the necessary proof thereof being made by the oath of James M. Hill John Hill & James R. Kitchens the subscribing witnesses to said will. It is therefore ordered that said will of William Ward be admitted to probate & placed on record as a will for personal & real estate, whereupon William V. White was qualified as executor named in said will & warrant of appraisement issue to Jno. Hately, Jas. Spurling, Henry A. Spencer, Edmond Head & Wm. Drake The last will & testament of Luke Bond deceased, was brought into court & the necessary proof thereof being made by the oath of George M . [ _ Cammon] one of the subscribing witnesses to said will. It is therefore ordered that said will of Luke Bond be admitted to probate & placed on record as a will for personal & real estate, whereupon the executor Joshua S. Calloway named in said will was qualified in terms of the law & warrant of appraisement issued accordingly The court then adjourned till court in course Wm. Harris Chair PAGE 97 The Honorable Inferior Court of Pike County Setting for ordinary purposes met pursuant to adjournment this 2nd Nov 1835 Present their Honors James Neal J. L. Blackburn Justices & Jno. B. Reid Ordered that Lewis [?] Parker be & he is hereby appointed administrator of the estate of Elizabeth Bond[?] alias Elizabeth Parker late of said County deceased in his giving bond with security in the sum of ten thousand dollars, whereupon he gave for security John Neal in a bond for above sum & was qualified in terms of the law ========= Ordered that Lewis Parker be & he is hereby appointed Guardian of the person & property of his minor son William N. Parker on his giving bond with security in the sum of twenty five hundred dollars, whereupon he executed the bond as directed & gave James Parker & James R. Blankenship for security & was qualified in terms of the law ======== In the showing of Mary P. Griffin & John R. Kindrick admix & admr of the estate of Anderson Griffin deceased, that they had in terms of the law published their notice that they should apply to this court for an order to sell the Negroes of said estate & no objections having been filed or rendered It is therefore ordered that said admix & admr be & they are hereby authorized to sell the Negroes belonging to said estate PAGE 98 Ordered that John Akin & William Akin be & they are appointed administrators of the estate of John Akin Senr. Late of said county deceased, on their giving bond with security in the sum of nine thousand dollars, whereupon they executed the bond directed by the court & gave Asa Sessions & Charley Mc Douglas for security & was qualified in terms of the law ======= It appearing to the court that Richard S. Walker one of the securities of Mary P. Griffin & John R. Kindrick admix & admr of the estate of Anderson Griffin deceased wishes to be discharged entirely from all & every liability as security aforesaid on said bond. It is therefore ordered that whenever said Mary P. Griffin & John R. Kindrick admis & admr as aforesaid shall give to the clerk of this court a new bond with good security in place of said R. S. Walker, then said R. S. Walker be & he is discharged from all liability on said bond as aforesaid The court adjourned till court in course Jnos.
