Horton of said State and County, desiring to avail himself of the Pension Act approved December 15th, 1894, hearby submits his proofs, and after being duly sworn true answers to make the following questions, deposes and answers as follows: 1. What is your name and where do you reside? (Give State, County and post office) Peyton F. Horton I reside in Pike Co., Ga - P. O. Williamson 2. Where did you reside on January 1st, 1894, and how long have you been a resident of this State? In Pike Co, Ga - have resided in this state all my life. 3. When and where were you born? Dec 10th 1816 in Hancock Co., Ga. 4. Did you volunteer in the Confederate Army or in the Georgia Militia? GA Militia 5. When and where did you enlist? In July 1864 in Atlanta, Ga. 6. In what company and regiment did you enlist? In Co. E, 7th Ga. Militia Reg't 7. How long did you remain in that company and regiment? From July 1864 till close of War, 1865 8. If you were discharged from same and joined another, or if you were transferred to another, give an account of such discharge or transfer. Neither 9. For how long a period did you discharge regular military duty? 9 months 10. When, where and under what circumstances were you discharged from service? In April 1865 at the surrender of the Confederate Army 11. What is your present occupation? have none not able to do anything 12. How much can you earn per annum by your own exertions of labor? nothing 13. What has been your occupation since 1865? Farmed as long as I was able 14. What sum would be necessary for your support for this pension year, and how much are you able to contribute in labor or income? About $75.00 -- can contribute nothing. 15. What is your present physical condition and how long have you been in such condition? I am in my 79th year, and unable to work. Can't see but (but is Underlined) little & on this account could not do much if I had strength But I am too weak to work, growing worse continually. 16. Upon which of the following grounds do you base your application for pension viz.: first, "age and poverty," second "infirmity and poverty" or third "blindness and poverty"? all three 17. If upon the first ground, state how long you have been in such a condition that you could not earn your support? If upon the second, give a full and complete history of the infirmity and its extent? If upon the third state whether you are totally blind and when and where you lost your sight? I have not been able to support myself for 10 yrs on account of infirmity caused from age and for tens years at times I was blind & at other times could see my way can see some now. 18. What property, effects or income do you possess? Nothing but a little house furniture. 19. What property, effects or income did you possess in 1893 and in 1894 and what disposition, if any, did you make of same? Owned 43 acres land in 1893. Sold it & paid some of my debts & left me in debt. I still owe money & nothing to pay with. 20. In what County did you reside during those years and what property did you then return for taxation? In Pike County in 1893 & 1894. Returned no property. 21. How were you supported during the years 1893 & 1894? My children fed me. 22. How much did your support cost for each of those years, and what portion did you contribute thereto by your own labor or income? Cost about $80.00. I contributed nothing. 23. What was your employment during 1893 & 1894? What pay did you receive in each year? Had no employment Nothing 24. Are you married and have you a family? If so, is your wife living and how many children have you? Give age and sex of children and their means of support? Yes, My wife is living. Have 12 children 7 sons living aged oldest about 42 - youngest 26 - 5 daughters - oldest 53. Youngest 20 yrs Youngest lives with me. They all have to live off of their labor. No other means of support. 25. Are you receiving a pension under any law of this State, if so what amount and for what disability? I am not & never have. Hood, of said State and County, having been presented as a witness in support of the application of Peyton F. Horton for pension Under the Act approved December 15th, 1894, and after being duly sworn true answers to make the following questions, deposes and answers as follows: 1. What is your name and where do you reside? Thos. J. Hood I reside in Spalding County within two miles of applicant. 2. Are you acquainted with Peyton F. Horton, the applicant, if so how long have you known him? Yes - I have known him 40 years. 3. Where does he reside and how long has he been a resident of the State? In Pike Co, Ga. & has resided in this state ever since I have known. 4. Do you know of his having served in the Confederate army or the Georgia Militia? How do you know this? He served in the Ga. Militia in the Company to which I belonged. 5. When, where, and in what company and regiment did he enlist? He enlisted in July 1864 in Atlanta in Company E, 7th Reg't Militia. 6. Were you a member of the same company and regiment? Yes 7. How long did he perform regular military duty, and what do you know of his service as a Confederate soldier, and the time and circumstances of his dis-charge from the service? About nine months, till 8th November in 1865 He made a faithful soldier 8. What property, effects or income has the applicant? (Give your means of knowledge) He has nothing at all - I know because I live near him visit him Frequently & know he has nothing. 9. What property, effects or income did the applicant possess in 1893 and 1894, and what disposition, if any, did he make of same? He had nothing In 1892 he owned a little piece of land but sold it & paid his debts as far as it went. 10. What is the applicant's occupation and physical condition? Has no occupation His physical condition is bad. He's not able to work from age & if he was able to work Couldn't see how to work. 11. Is the applicant unable to support himself by labor of any sort, if so, why? He is on account of his age, physical condition, and blindness. 12. How was he supported during the years 1893 and 1894? By his sons - Wm & James supported him in 1892 & 1893. He son Peyton supported him 1894 13. What portion of his support for these years was derived from his own labor or income? Nothing at all 14. Give a full and complete statement of the applicant's physical condition that entitles him to a pension under the Act of December 15th, 1894? His physical condition renders him totally unable to support him by labor of any sort. 15. What interest have you in the recovery of a pension by this applicant? Blassengame, Ordinary ----------------------------------- AFFIDAVIT OF PHYSCIANS. _____________ STATE OF GEORGIA } Pike County } Personally came before me, Dr. J. C. Beckham and Dr. J. C. Beauchamp, both known to me as reputable physicians of said county, who being severally sworn, say on oath that they have examined carefully Peyton F. Horton, applicant for pension under the Act of 1894, and after such personal examination, say that his precise physical condition is as follows: Cannot see but to a limited amount, Suffers pain on walking any distance and is weak generally being about 79 years old, which is truly the cause of his disability. We further say on oath that the physical condition of applicant renders him unable to labor at any work or calling sufficient to earn a support for himself, and that we have no interest in said pension being allowed. STATE OF GEORGIA, } Pike County.} I, Thos. J. Blassengame, Ordinary in and for said County, hereby certify that the applicant, Peyton F. Horton, resides in said County, and was a bona fide resident of this Sate on the first day of January 1894, and that the witnesses, viz: Thos. J. Hood of Spalding Co, Dr's J. C. Beauchamp & J. C. Beckham are of trustworthy character and that their statements are entitled to full faith and credit. I further certify that before answering the foregoing questions, the applicant and each witness took the oath hereon prescribed, and that the full text of the affidavits was read to the applicant and witnesses before same were signed. I further certify that the tax digests of Pike County show that applicant returned for taxation in his name, 1893, no dollars of property, and in 1894, no dollars of property. State of Georgia } Fayette County } Personally before me comes Permelia Horton of said County, who, after being duly sworn, on oath says, that she is the widow of P. F. Horton to whom in the County of Pike State of Ga. she was married on the 11 day of May 1865 and that she remained his wife, and resided with him to the date of his death in May 1906 and that she has not since his death remarried. At the time of his death he was a resident of Pike County in __________ said State of Georgia and he was on the Indigent Pension Roll of the State and paid a pension of $80.00 in Pike County for 1906 per annum on account of being a soldier in Company Co E - 7 - Ga Regiment Militia (Volunteer of State Militia). At the death of P. F. Horton he was in the use and possession of the following property: nothing of the cash value of $: 00 What property of any kind and of any value have you in your use, control and possession now and the cash value. (State fully.) Nothing None - Acres land None - Horses and Mules None - Hogs, Cows, etc. Total Cash value of all property $ (blank - not completed) That she is now a bona fide resident citizen of said County of Fayette and she has so continuously resided since 1 day of Jan 1908. Franklin known to be responsible and truthful persons, residing in said County, who after having duly sworn an oath, say that of their own personal knowledge Mrs. Permelia who made the foregoing affidavit, is the lawful widow of P. F. Horton who died in Pike County in the State of __________ on _____ day of May 1906 and that she has not since remarried. That she became the wife of P. F. Horton on the 11th day of May 1865 and that she and he resided together as man and wife continuously since 11 day of May 1865 and that the P. F. Lewis Ordinary of said County, do certify that, I know Mrs. Permelia Horton the applicant for this pension and that she is the person she represents herself to be, and that she is a bona fide continuing resident of said County and was on the 1st Jan. 1910 That is also know J. M. Franklin & W. F. Franklin witness as to marriage and I also know J. S. Thornton & C. A. Thornton who I know to be a resident free holder of said County that all of the foregoing were duly sworn by me before signing the respective affidavits and that they are truthful and trustworthy and their statements are entitled to full faith and credit. That the tax Books of Fayette county shows that Permelia Horton returned property to the amount of 00 for 1908 $00 for 1909 $00 for 1910 $00 Sworn under my hand and official seal of office this 18 day of Oct 1910 (Seal) S. B. Lewis, Ordinary Fayette County [Permelia passed away on 16 April 1913 and is buried at New Hope Baptist Church Cemetery in Fayetteville, Fayette Co., Georgia. Peyton is buried in an unlocatable grave near where his home was in Williamson, Pike Co., Georgia]
