Wilson near Beeks. Wess voluntarily came to Zebulon Sunday and surrendered to the sheriff, stating that he wanted to go "away back in jail." He was given a preliminary hearing at the courthouse Tuesday before Justice J.T. Baker. A number of witnesses were sworn which proved conclusively that Isaih went to Wess’ house in an intoxicated condition with a shotgun and was cursing out the whole business and threatened to kill the entire family. Wess, so the evidence showed, begged him to go away which Isaih refused to do and fired his gun at Wess while the latter was sitting in his own house. Wess got his gun and fired two shots, both of which took effect in the body producing almost instant death. The evidence showed a clear case of justifiable homicide, both in defense of self and habitation.
