Pound Last Monday afternoon, a few minutes after 7 o'clock, the report of a shot gun was heard on Market street. It was soon ascertained that Mr. Wm. T. Respess had shot and killed John H. Pound, in a personal difficulty, on the sidewalk between J.P. Scott's store and Luke Dumas' barroom. It seems that Mr. Pound and Mr. Respess had some words, and for the purpose of avoiding a difficulty, Mr. Respess went into the store of J.P. Scott and remained there some time, and when he got ready to start home he picked up his shotgun, which had been left there by a gentleman who had been using it. When Mr. Respess got to the door Mr. Pound was sitting near the door of Luke Dumas' bar. Mr. Pound got up and made some remarks and started towards Mr. Respess with his knife in his hand pushing Mr. Reeder along between him and Respess. Mr. Respess said to Mr. Pound, "hold up or I will shoot." Mr. Pound continued to advance and said, "let her roll; let her roll; God damn it, let her roll," and when in four or five feet of the gun, he pushed Mr. Reeder to one side and made an effort to catch the gun. Just at that time Mr. Respess fired one barrel, the load entering the right side of Mr. Pound, making a fearful wound, from the effects of which he died in fifteen or twenty minutes. After Mr. Pound was shot he remarked to Mr. Respess, "Bill, you have killed me." Respess replied, "I could not help it, I had to do it." Mr. Pound made some other remarks before he died, the substance of which was that he thought Respess was "funning." After the shooting Mr. Respess surrendered himself to Marshall Quinlan. He was guarded in his room until Wednesday afternoon, when the preliminary trial was commenced before Justices W.A. Prout, J. Powell and J.B. Hanson. The State was represented by T.E. Murphy, J.E. Redding, W.R. Taylor and A.A. Murphy. The defendant by J.A. Hunt, J.J. Rogers and Judge J.I. Hall. The investigation continued until Tuesday afternoon. When the evidence was all in, the attorneys for the State withdrew the warrant and a bond of five thousand dollars was agreed upon by the attorneys on both sides for the appearance of Mr. Respess at the next term of Pike Superior Court. The bond was promptly given and Mr. Respess released.
