All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ga/gafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: William Russell dragonraj@comcast.net September 24, 2006, 10:49 am Source: Pike County Probate Court Written: February 10, 1864 Recorded: April 6, 1864 Georgia Pike County I William Britt of the County and State doth make, appoint and declare this to be my last will and testament 1st I give, devise and bequeath to my wife Emily Britt, until my youngest child becomes of age, all my property, both real and personal, which is to be kept together under her exclusive control and direction during that time for her own use and for the education and maintenance of my Children 2nd I give my said wife authority to dispose of any portion of said property to my older children as they become of age or as soon as in her opinion it may be proper to do so, provided the said amount of property shall not exceed the distribution share to which they may be entitled. 3rd When my youngest child becomes of age, it is my wish that my property shall be equally divided between my wife and Children share and share alike, each child to account in said distribution for any portion which may have been advanced previously. 4th I hereby appoint my wife Emily Britt my executrix and my friend Rev. Andrew G. Peden my Executor to execute the provisions of this will. In testimony where of I have hereunto set my hand and seal this 10th February 1864 W. G. Britt Signed, sealed and declared by the testator as his last will and testament in our presence and in the presence of each other on the day and year aforesaid J. A. Williams S. C. Jones Wm. D. Alexander April Term 1864 Pike Court of Ordinary Came into open Court at this regular term of the Court J. A. Williams and S. C. Jones being duly sworn, depose that they saw Wm. G. Britt sign and publish the within as his last will and testament while of sound and disposing mind, that they witnessed the same for him at his request and in his presence and of each other and that the same was executed voluntarily by him on the day it purports to have been executed, and that they saw Wm. D. Alexander sign the same as a witness J. A. Williams S. A. Jones Sworn to and subscribed before me this 4th day of April 1864 Jno. H. Mangham Ordinary We do solemnly swear that this writing contains the true last will of the within named Wm. G. Britt deceased so far as we know or believe, and that we will well and truly execute the same in accordance with the laws of this State. So help us God M. E. Britt A. G. Peden Before me Jno. H.
