All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ga/gafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: William Russell dragonraj@comcast.net September 4, 2006, 10:04 am Source: Will Book C P. 64-65 Pike County Probate Court Written: March 9, 1850 Recorded: July 4, 1850 State of Georgia Pike County I Lucinda Brown widow being of Sound Disposing mind and Memory do make and ordain this my last Will and Testament in manner and form following that is to say - after payment of my just debts and funeral expenses I desire & bequeath my whole estate to my son Thomas Augustus Brown and to my Executors herein after named for the sole & separate use of my daughter Mary Lucinda Brown in the following manner I devise that a fair and just estimate be made of all that my said son and daughter may be worth at the time of my death and that my estate be so divided that when each ones share of my estate is added to what each of my Children may have at the time of my death the estate of each child may then be equal. The share which may fall to my son I leave to him in fee simple and the share of my daughter I leave to my Executors to by them settled for the sole & separate use of my Said daughter far from the control debts or encumbrances of any husband she may then or at any further time have and in trust for the use of such person or persons as my said daughter may by her last will and testament appoint. Lastly I constitute and appoint my said Son & son in law Henry Jones Executors of this my last will and testament hereby revoking all previous wills hereinto made by me - On reflection I have determined by my will to do something for my daughter Martha Ann Jones wife of Henry Jones in addition to what I have already done. I therefore declare it to be my will notwithstanding what is above written that I give and bequeath to my said daughter Martha Ann Jones her choice of one of my Negroes any one I may have at the time of my death to have and to hold the same during her natural life of her the said Martha Ann Jones & at her death it is my will that such slave as she may select then return to my estate to be divided between my son Augustus and daughter Mary Lucinda Brown as is above and already set forth in regard to the rest of my estate. Signed sealed published and declared for and as the will of Lucinda Brown being [ _ ] as attesting [ _ ] [ _ ] interlined [?] as to names of executors before execution in presence of each other witnesses [ 5 words unreadable] signed the same as witnesses this 9th March 1850 Lucinda Brown her mark T. J. [ _ ] John Benton James H. Stark Pike Court of Ordinary July Term 1850 Present their Honors Benson Roberts, John H. [ _ ] & William O. Kendrick [?] Judges of said Court In person came James H. Stark in open court who being duly sworn depose and saith that he saw Lucinda Brown sign & seal and heard her publish and declare the above writing to be and contain her last will & testament that she signed sealed published and declared the same as her last will and testament in the presence of Thomas J. [ _ ], John Benton and these [ _ ] that said Thomas J. [ _ ], John Benton together with the deposed subscribed the same as witness at the request of the Testatrix and in her presence and in the presence of each other and that said Lucinda Brown signed the same freely voluntarily and without any manner of compulsion. Jones do swear that this writing contains the true last will and testament of the within named Lucinda Brown deceased so far as I know or believe and that I will well and truly execute the same by paying first the debts and then the legacies contained in said will as far as her goods and chattels will thereunto extend and the Law charge me: and that I will make a true and perfect inventory of all such goods and chattels so help me God Henry W.
