Pike County } I - James Cawthen of the Said State and County, knowing that life is uncertain, deam it right and proper both as respects my family and myself that I should make a disposition of the property with which a Kind Providence has blessed me, do therefore make this my Last Will and Testament, hereby revoking all others heretofore made by me. Item 1st I desire and direct that my body be buried in a decent and Christian like manner suitable to my condition and circumstances in life. My soul I trust shall return to God who gave it as I hope for eternal Salvation through the merits and atonement of the Blessed Lord and Saviour Jesus Christ. Item 2nd I desire and direct that all my just debts be paid without delay as hereinafter directed for I am unwilling my creditors Should be delayed in their rights. Item 3rd I give, bequeath and devise to my beloved wife Sarah or Sarah Cauthen during her natural life or widowhood all my lands of which I am possessed together with all the stock of all kinds whatever and farming utensils and all of the Household and Kitchen furniture together will all money's notes and all other property of all kinds of which I am possessed with the exception of one note for five hundred dollars hereafter described. Item 4th I give, bequeath and devise to my beloved son John James Cawthen five hundred dollars in a note on my beloved brother John Cawthen and I hereby appoint my beloved friend William G. Duke as his guardian to take charge of the same until my son shall arrive at his majority. Item 5th I give, bequeath and devise to my beloved daugher Lenora, wife of Burwell G. Rivers the sum of one dollar. And to my beloved daughter Louise, wife of William Mills, I give bequeath and devise the sum of one dollar. Item 6th At the death or intermarriage of my beloved wife Sarah Cawthen I hereby give, bequeath and devise all the lands, stock of any and all kinds, farming untensils together with all the household and kitchen furniture and all money's, notes and all other property on hand to my beloved Son John James Cawthen. Should my beloved wife Sarah, die or intermarry before my Beloved son John James Cawthen should arrive at the age of twenty one years, I hereby appoint and request my beloved friend William G. duke to act as his guardian to take charge of the same until my son arrives at the age of twenty one years. Item 7th I hereby constitute and appoint my beloved wife Sarah Executrix to execute this my last Will and Testament during her natural life or widowhood and that She do so without making any returns to the Court of Ordinary or being in any way responsible to any person unless it be made fully and plainly to appear that she is squandering and wasting the said property unnecessairly. Should my beloved wife Sarah die or intermarry before my beloved Son John James Cawthen arrives to the age of twenty one years, I hereby constitute and appoint my beloved friend William G. Duke Executor to execute this my Last Will and Testament or so much thereof as shall remain not executed. Settle, do Pike County} solemnly swear that we Saw James Cawthen Sign, Seal and Heard him declare and publish this writing to be and contain his Last Will and Testament and at the time thereof he was of Sound and disposing mind & memory and that he did it freely without compulsion to the best of our knowledge and belief, and that we Signed the Same in the presence of each other and the Testators, and we also Swear That we Saw Thomas B.
