Daniel I Isaac R. Daniel of the County and State aforesaid being of sound disposing mind and memory do make this my last Will and Testament Item 1st I will that after my death my Negro woman that I now have and any other Negroes that I may own at the time of my death be sold also my buggy and such other property as I may have except household furniture which I desire my beloved wife Lavinia to keep at a fair valuation to be valued by discreet and proper persons of the Court so desire otherwise to be sold. Item 2nd I will that my whole Estate be equally divided between my beloved wife and daughter Fanny Elizabeth and such other children as we may have at my death or be born to me after by my wife Lavinia. I will my wifes part to her during her life and after her death to go to and be the property of her child or children by a second or other husband should she have any and in the event of her death without other children than mine, then the said property is to go to and be the property of our Child or Children during her or their lives and after her or their death to go to and become the property of her or their Children. I will to my daughter Fanny Elizabeth, an equal share of my estate with her mother during her the said Fanny Elizabeths life far from the debts or liabilities of any husband. And after her death I will the said portion so given to Fanny Elizabeth to any Child or Children she may have at the time of her death. Item 3rd To more fully explain my will I here again state that I will desire that should I die leaving my beloved wife Lavinia and our daughter Fanny Elizabeth and no other child that my property be equally divided one [ _ ] of which is to be for the use of my beloved wife Lavinia during her life free from the debts or liabilities of any future husband and after her death to be the property of her children born to an other or future husband and if no such children belonging then to be the property of Fanny Elizabeth for her life and at her death to go to and be the property of her children. Item 4th Should we have another or other children at the time of my death or within the usual time of gestation thereafter I then will and desire that my property be devided into as many parts and shares as we have Children and my wife Lavinia and that each one that is my wife Lavinia and each of our children take share and share alike for their lives and after their deaths to go to and be the property of their children. Isaac R. Daniel Signed Sealed declared and published by Isaac R. Daniel as his last will and Testament in the presence of us the Subscribers who subscribed [ _ ] hereto in the presence of Said Testator at his special instance and request this 13th March 1851 Hartford Green John Neal [?] J. G. Westmoreland State of Georgia Pike County I Hartford Green do solemnly swear and I John G. Westmoreland do affirm that we saw Isaac R. Daniel sign, seal, publish and declare this writing to be and contain his will that at the time thereof he was of sound disposing Mind and Memory and that he did it freely without compulsion to the best of our knowledge and that we saw John Neal sign the same as witness. Daniel do solemnly swear that this writing contains the true last will and testament of Isaac R. Daniel deceased as far as I know or believe and that I will well and truly execute the same as administrator with said wife [ _ ] by first paying the debts and then the legacies contained in said will as far as his goods and chattels will hereunto extend and the law charges me and I will make a true and perfect inventory of all such goods and chattels so help me God N.
