I Crispan Davis, of said state and County, being of advanced age and knowing that I must shortly depart from this word desire it right and proper both as respects myself and my family that I should make a disposition of the property with which a kind providence has blessed me I therefore make this my last will and Testament hereby revoking and annulling all others heretofore made by me. Item First- I desire and direct that all my just debts be paid without reserve by my Executors, here in after named as I am unwilling that my creditors should be delayed of their rights specially as there is no necessity for delay. Item Second- I give and desire to my beloved wife Elizabeth all my property to wit a Negro woman name Kit about twenty three years of age; Ben a Negro boy about eleven years of age, Moses about nine years of age Henry about seven years of age Taushah a Negro girl about two years of age; Also all my household and kitchen furniture, free from all charge or limitation whatever to her own proper use benefit and behoof during her natural life. Item Third- I give and bequeath at the death of my wife Elizabeth the following property to wit: to my hereinafter named children To Jonathan and Austin the negro woman Kit and her increase to them and their heirs forever. Item fourth- I bequeath to Richard J, my Negro boy named Ben about eleven years of age to him and his heirs forever- Item Fourth- I give and bequeath to my daughter Mary Ann Louisa my Negro boy Moses about nine years of age to her and her heirs forever- Item Fifth I give and bequeath to my son Ebenezer my Negro boy Henry about seven years old to him and his heirs forever. Item Sixth. I give and bequeath to my daughter Elisabeth S. my negro girl Taushah about two years of age to her and her heirs forever- Item Seventh- I also direct that at the death of my wife Elizabeth my household and kitchen furniture be equally divided between my children Jonathan, Austin, Richard J., Mary Ann Louisa, and Elisabeth to have and to hold forever- Item Eighth. I give and bequeath to my son William Davis five Dollars to be paid to him by my executors- Item Ninth. I give and bequeath to my son Crispan Davis five Dollars to be paid to him by my executors- Item Tenth, I give and bequeath to my daughter Amanda Ann Wilson wife of John Wilson five Dollars to be paid by my Executors Item Eleventh I give and bequeath to my daughter Tabitha Draper wife of John Draper to be paid to her by my Executors. Item Twelfth. I constitute and appoint my two sons Jonathan and Austin Executors to this my last will and Testament this April 3rd 1851 Chrispan (his x mark) Davis LS Signed, Sealed, declared and published by Crispan Davis as his will and Testament in the presence of us the subscribers who subscribed our names hereto in the presence of said testator and of each other this Appril 3rd 1851 James K Holsey Marcus L Billingsley John A Holsey State of Georgia Pike County We James K Holsey and Marcus L Billingsley do solemnly swear that we saw Crispan Davis (by making his mark) sign + seal and heard him publish and declare this writing to be and contain his will that at the time thereof he was of sound disposing mind and memory the he did it freely without compulsion to the best of our knowledge and the we also saw John A Holsey sign the same as witness Attend in open court this 7th July 1851 Wiley O Mangham C.C.D. James K Holsey Marcus L Billingsley State of Georgia Pike County I Jonathan Davis do solemnly swear that this writing contains the true last will and Testament of Crispan Davis deceased so far as I know or believe and that I will will and truly execute the same by paying first the debts and then the legacies contained in said will as far as his goods and chattels will thereunto extend and the law charges me and that I will make a true and prefect inventory of all such goods and chattels so help me God- Sworn to and subscribed in open court this 7th July 1851 Wiley O Mangham C.C.D.
