All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ga/gafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: William Russell dragonraj@comcast.net October 15, 2006, 3:39 pm Source: Pike County Probate Court Will Book C Written: September 20, 1847 Recorded: May 2, 1848 Georgia Pike County September the 20 1847 I Benjamin Elliott being in my proper mind but calling to mind the certainty of death I do ordain this my last will and Testament in the name of God Amen I do wish to dispose of any worldly goods in the following manner 1st Benjamin Elliott minor son of Samuel Elliott and Samuel Elliott son of the same I give fifty dollars to each one after my death and I ordain my son William Elliott their Guardian till they become of age. 2nd I let my two daughters Nancy and Lidda have the plantation and Negroes whereon I live one year after my death and then all my property and the crop that is made on the place to be sold and equally divided amongst all my children except Samuel Elliotts children that I have given the fifty dollars to and I do ordain William Elliott and George W. Caumon [?] my executors to this my will and if either of Benjamin or Samuel Elliott survives or both should die before they should come of age for their money to return to my estate and be divided as the rest of my property Benjamin Elliott Signed in presence of us the day and date above mentioned Zah. Fryer Josiah Holmes William Willis Georgia Pike County We Josiah Holmes and William Willis solemnly swear that we saw Benjamin Elliott Sign, Seal, publish and declare this writing to be and Contain his will and at the time thereof he was of sound disposing mind and memory and that he did it freely without compulsion to the best of our knowledge and that we saw Zachariah L. Fryer sign the same as witness. Josiah Holmes William Willis Attest in open court this 1st May 1848 Wiley E. Mangham CCO Georgia Pike County We William Elliott and George W. Caumon [?] do solemnly swear that this writing contains the last true will and Testament of Benjamin Elliott deceased so far as we know or believe and that we will well and truly execute the same by paying first the debts and then the legacies contained in said Will as far as his goods and chattels will thereunto extend and the law charge us and that we will make a true and perfect inventory of all such goods and chattels so help us God.
