Peden Georgia Pike County In the name of God Amen. I Andrew G. Peden of the county of Pike in said State, being advanced in age but of sound and disposing mind and memory & knowing the uncertainty of life, and feeling it to be my duty to give full expression to my wishes as to what disposition shall be made after my death of the property with which a kind Providence has blessed me, do hereby make, publish, and declare this to be my last Will and Testament hereby revoking all other wills heretofore made by me. Item 1st I desire and direct that my body shall be buried in a decent & Christian like Manner & I trust that my soul shall return to God who gave it. Item 2nd I desire and direct that all my just debts be paid as soon after my death as shall be expedient. Item 3rd Many years before the War, I was Guardian for D. D. Peden, who had an interest in the David Dangler Estate. This interest was settled long years ago, with said D. D. Peden, by my turning over to him a fine horse named Tipper for five hundred dollars - a pair of Ponies for six hundred dollars in 1859 for which I hold his receipt - A balance due me for land sold D. D. Peden, to wit: Lot No. 209, & part of No. 210, in first District of Pike County , of five hundred and thirteen dollars - A note for borrowed money to Capt Jack Mitchell, which I paid for D. D. Peden & which he has never repaid me: besides the above I furnished D. D. Peden many other items of Personal property, cattle, sheep, provisions, in amounts not remembered, but aggregating largely more than his interest in the Dangler Estate, & have considered the matter settled very many years ago. I simply specify the above so that they may not be confused or confounded with other items hereinafter named which I charge D. D. Peden with, as advancements on his share in my estate, to wit: I gave him two hundred and two and one half acres of land, No two hundred and forty valued at ten dollars per acre - two thousand and twenty five dollars, and a horse named Elbert, which cost me another horse, worth one hundred dollars and one hundred twenty five dollars in money which I paid in the swap. One mule named Julia, valued one hundred and twenty five dollars - A mare named Clyde vbalued at one hundred & fifty dollars, making in the aggregate, twenty five hundred & twenty five dollars, which I have charged & do hereby charge to D. D. Peden as an advancement from my estate to be accounted for. Item 4th I was also Guardian of Ann E. Tolbert, wife of J. R. Tolbert; Her interest in said Dantgler [sp?] estate, I settled with her in 1861 - Jany 9th, taking her receipt - Besides this I advanced to her, of her interest in my estate as follows: I gave her lot of land two hundred & thirty nine in first District of Pike County, which I have charged to her - do charge to her at ten dollars per acre, Two thousand and twenty five dollars. Also I have made her a deed to lands in Arkansas where she now lives, valued to her at three hundred & thirty six dollars - Also a valuable horse worth one hundred & fifty dollars & also forty dollars in cash Making in all, so charged to her, on account of her interest in my estate, twenty five hundred & fifty one dollars. The deed to lot of land two hundred & thirty nine by her directions, and her husbands directions, was made to W. J. Kincaid; my daughter & her husband receiving the money for the same, and for these advancements she is to account to my Estate. Item 5th I have made a deed to my beloved wife to my home place - this is not to be charged to her as advancement. She owns the parlor furniture & piano & the company room furniture - It is my will and direction that after my death, my wife Margaret C. Peden, shall have during her lifetime all my household & kitchen furniture, and all my stock, cattle, corn, fodder, provisions, farm supplies, vehicles, farming implements, hogs, money and all personal property - to have and to use for and during her natural life for her benefit & comfort and after her death the same to be divided or sold & the proceeds divided as hereinafter provided. Item 6th I have advanced to my daughter Estelle, wife of J. W. Sullivan two hundred and nine and a fraction acres of land valued at ten dollars per acre, amounting in value to two thousand and ninety one & 66/100 dollars bought from H. G. , T. C. and J. W. Sullivan the deed to which was made to her by my direction & for which she has been and is now charged as an advancement & for which she is to account as an advancement. Item 7th I have given to my daughter E. E. Sullivan called Dora, wife of T. C. Sullivan , two hundred and nine acres of land by deed of this date, which is charged to her at ten dollars per acre, to wit Two thousand & ninety dollars for which she is to account as an advancement from my estate. Item 8th It is my Will and direction that all the remainder of my said estate not herein mentioned or that may hereafter be required by me & that I own at the time of my death, shall be for the use & benefit of my beloved wife for and during her natural life and at her death the same with the property given to her for life, in the fifth item of this my will, shall be sold & the proceeds divided between my children as provided for in the next item of this my will or if they shall see proper & can agree on the same it may be divided in kind upon the terms mentioned in the next item of my will. Item 9th It is my will and direction that after the death of my beloved wife & when the time shall arrive for the division or distribution of my estate that each and all my children (or their representatives) to wit: D. D. Peden, Ann E. Tolbert, Estelle Sullivan wife of J. W. Sullivan & Dora Sullivan wife of T. C. Sullivan shall be made equal, that is to say, that D. D. Peden, Estelle Sullivan & Dora Sullivan shall each receive from my estate, such an amount as will be required, when added to the amount of advancement, which I have charged herein to each of them, will make the sum of twenty five hundred and fifty one dollars to make them [added word: cash] equal in amount to the amount of advancement I have charged to the said Ann E. Tolbert When this is done then I will and direct that the remainder whether in money or property be equally divided between my said children (or their representatives) share and share alike one of each of said four shares to be given each of my children (or their representatives) Item 10 I hereby nominate and appoint my beloved wife Margaret C. Peden Executrix of this my last will having full confidence that she will faithfully carry out the provisions of the same but do not wish that she shall be required to make annual Returns to the Court of Ordinary, and after her death I desire that my sons in law T. C. & J. W. Sullivan shall qualify as executors & wind up the unadministered estate. Witness my hand and seal this April 8th 1892 A. G. Peden We the undersigned at the request of Andrew G. Peden saw him sign, seal, publish and declare the foregoing to be his last Will and Testament. He signed the same in our presence and at his special instance and request we sign our names as witnesses in his presence and in the presence of each other this April 8th 1892 J. W. Hogg D.P. Blake E. W. Hammond Georgia Pike County I D. P. Blake do swear that I as well as J. W. Hogg and E. W. Hammond saw the within named A. G. Peden sign and publish the within paper as his last Will and Testament. That I subscribed the same as a witness thereto at the special instance and request of the said A. G. Peden, and in his presence as did also J. W. Hogg & E. W. Hammond, that the said A. G. Peden signed the same freely and voluntarily and was at the time of such signing of sound and disposing mind and memory. D. P.
