Milner Georgia Pike County I Simeon C. Milner being of sound mind and memory, and deeming it fit that I should make proper disposition of my worldly affairs, ordain, declare, and publish this my last will and Testament Item 1st I direct that my body receive Christian burial on the lot I now own in the Church yard of the Barnesville Baptist Church, and that a fitting monument be erected thereon in my memory Item 2nd My son Simeon C. Milner Jr. owes me two hundred and fifty eight dollars, and I hereby direct that he shall receive this as an advancement and that he shall not share in my Estate until each of my heirs, whose names are hereby mentioned, Benjamin J. Milner, Rebecca Bray [?] of the State of Florida, Acalia Adams (my grand daughter and the daughter of my deceased daughter Elizabeth Adams) and my wife Mrs. Elmyra Milner, shall each receive a like sum of two hundred and fifty eight dollars. Item 3rd After each of my five heirs above mentioned have been made equal share in my Estate I direct that the remainder shall be equally divided between the five; share and share alike Item 4th All my heirs above named being of full age of 21 years I direct that they shall get together and make this equal distribution of my Estate as above stated. First advertising and selling all my real estate and personal property to the highest bidder, dividing the real estate into such size parcels as they may agree on and making the terms of the sale such as they may deem best and I direct that this sale and distribution be made without any administration of my estate and that a joint deed made by my said heirs shall be a valid deed to my real estate of which I may die [--?--] and possessed and that the title to my personal property shall pass by the public sale as above directed Item 5th I hereby direct that my son Benjamin J. Milner shall be and is hereby appointed to collect all debts which may be owing to me at the time of my death, and that he shall account for all such collection as part of my Estate. Item 6th I own two shares of stock in the Barnesville Manufacturing Company, and I desire that this may be sold at public or private sale as my heirs may think best and I desire that my son Benjamin J. Milner my Executor sign all papers necessary to its proper transfer the [--?--] of the name of my son Simeon C. Milner in the 13th line of the first page were done before the signing of this will Signed sealed and delivered as my last will and Testament in the presence of the witnesses whose names are hereto attached as said witnesses who signed the same in my presence and in the presence of each other and who also saw me sign the same in their presence. Turner, named as a witness to the foregoing writing purporting to be the last will and Testament of Simeon C. Milner deceased who being sworn says that he saw Simeon C. Milner sign the same as his last will and testament and that he signed the same freely & voluntarily in his presence and in the presence of W. A. Prout & W. H. Smith the other witnesses and that they all signed as witnesses in his presence and in the presence of each other, that he was at the time of such attestation and signing by himself of sound and disposing mind and memory B.
