All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ga/gafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: William Russell dragonraj@comcast.net March 4, 2004, 4:29 pm Source: Will Book C Pike County Probate Court Written: December 31 1849 Recorded: January 14 1850 State of Georgia Pike County First I Josiah Matthews being of infirm health but of sound disposing mind and memory (thanks to God for his favor) do constitute and ordain this my last will and testament revoking all others viz - after paying all my just debts which are few - I will to my wife Sarah at her full control and disposal from and after my death, Simon a Negro man, Cily a Negro woman and all her children at present four and their increase and nine hundred and seventy three dollars in money and two horses and my carriage and harness and two cows and calves and about twenty head of hogs (those Negro John feeds at the mouth of the cave or their like) and all my household and kitchen furniture and a sufficiency of corn, meal, wheat _?_, _?_ , oats _?_ necessary for a years support of herself and the above bequeathed living creatures. In like manner I will to her the lot of land on which I live viz - lot number Forty nine in the Seventh District of originally Monroe but now Pike County and two and a half acres off of lot number (305) Three hundred and five in the Eleventh District of originally Monroe but now Upson County lying on the west of the cave heading south and adjoining number 49 so as to include my spring. Secondly Having herein bequeathed to my wife Sarah more than I on the 20th November 1839 gave in trust to _?_ for her, after fulfilling said bequest I will that all else of my Negroes be put into eight lots or parcels as near of equal value as can conveniently be done, having some respect to their families, and then to be drawn for one part to be given to my daughter Charlotte Boyt, an another part to be given to my daughter Sarah Fryer, another part to be given to my son Thomas Matthews children, another part to be given to my daughter Elizabeth McDaniel, another part to be given to the daughter of Isaac Matthews, another part to be given to my son Francis S.(?) Matthews, another part to be given to my son Charles S.(?) Matthews and another part to be given to my son John J. Matthews Thirdly I will that all else of my property which has not been herein before bequeathed be sold to the highest bidder or a _?_ the time discretionary with my executor and the proceeds after paying my just debts and the afore mentioned legacies be used as a fund to equalize, so far as it may do so, the said eight parts to the said eight legates children and grandchildren mentioned in the second section of this my will taking also into account in making an equal distribution between said eight which I will thereto have of my property as a part of my estate division and the accounts I have against several of my legates as may hereafter make against them or any of them during my lifetime _?_ _?_ they are against Charlotte Boyt and her husband James Boyt ($1294.45) twelve hundred ninety four 45/100 dollars; against Sarah Fryer and her husband Z.L. Fryer ($300) three hundred dollars; against Thomas Matthews and his children nothing; against Elizabeth McDaniel ($1770) seventeen hundred and seventy dollars; against Isaac Matthews and his daughter ($372) three hundred and seventy two dollars; against Francis S.(?) Matthews ($2504) twenty five hundred and four dollars; against Charles S.(?) Matthews ($3934. 69) thirty nine hundred and thirty four 69/100 dollars and against John J. Matthews ($3323) thirty three hundred and twenty three dollars and not to bear interest until the final distribution of my estate say about twelve months after letters testamentary are granted. Fourthly I will four hundred dollars to Milton Cathern as an exception(?) to the third section distribution of monies of my estate. Fifthly I will that Zachariah L. Fryer, Thomas N. Willis and Milton Riveire(?) be and they are hereby appointed and constituted executors to this my last will and testament. Willis and James Anderson do solemnly swear that we saw Josiah Matthews sign seal publish and declare this writing to be and contain his last will and at the time thereof he was of sound disposing mind and memory and that he did it freely without compulsion to the best of our knowledge this 8th day of January 1850 C.C. Willis and Milton Riveire do solemnly swear that this writing contains the true last will and testament of Josiah Matthews deceased so far as we know or believe and that we will well and truly execute the same by paying first the debts and then the legacies contained in said will as far as his goods and chattels will thereunto extend and the law charges us and that we will make a true and perfect inventory of all such goods and chattels so help us God.
