I John McKinley of the county of Pike and the State of Georgia being of sound mind and memory and considering the uncertainty of this frail and transitory life, do therefore make, ordain, publish and declare this to be my last Will and Testament. That is to say; First after all my just and lawful debts are paid and discharged, the residue of my estate real and personal I give bequeath and dispose of as follows, to wit - To my beloved wife Margaret H. McKinley I give and bequeath one hundred acres of land off of the west part of the lot on which I am now living to include the dwelling and all the improvements thereon my Negro woman Ellen and all of my household and kitchen furniture, two milk cows and calves, the mare mule I now own and all the corn fodder and provisions I now have or shall have at the time of my decease and all the pork hogs now up at the pen and one sow and pigs during the term of her natural life and after her death, the land which I now give her to revert back to my estate and be sold by my executors and the proceeds there of to be divided equally between my sons James M. McKinley, Charles C. McKinley, Midas L. McKinley, John W. McKinley, Silas McKinley, and David McKinley, and the Negro woman Ellen and her increase after the child she is now pregnant with, to be sold and the proceeds of her sale to be divided equally between my daughter Mary C. McKinley and my grand daughter June Littleton(?), and the proceeds of the sale of Ellen’s increase as before specified to be divided equally between all of my heirs; and all the other property which I gave my wife and its increase at the time of her death to be sold and the proceeds thereof divided equally between my heirs. To my sons Charles C. McKinley and James McKinley I give and bequeath all that tract or lot of land on which the said Charles C. McKinley is now living to be divided equally between them in quantity and valuation excepting and reserving all the prime timber suitable for sawing lumber which is to go with the saw mill I now own. The remainder of the lot on which I now live and seventy five acres off the north part of lot number one hundred and thirty four adjoining the lot on which I now live, I give and bequeath to all my sons as aforesaid to be equally divided between them in quantity and valuation and including all the appertainances thereof and the lumber reserved off of the lot I have given to James M. and Charles McKinley all my Negroes not otherwise disposed of together with the one that my Negro woman Ellen is now pregnant with and all of my other property not otherwise disposed of to be sold by my executors and the proceeds of the sale thereof to be equally divided among all of my heirs. _?_ I make constitute and appoint my son Midas L. McKinley to be my executor of this my last will and testament hereby revoking all former wills by me made. In witness whereof I have herein subscribed my name and affixed my seal this twenty fourth day of November in the of our Lord one thousand and eight hundred and fifty six. John McKinley The above written instrument was subscribed by the said John McKinley in our presence and acknowledged by him to each of us and he at the same time Published and declared the above instrument subscribed to be his last will and testament; and we at the testators request and in his presence have signed our names as witness hereto on the day and year aforesaid. Cook do solemnly swear that we saw John McKinley sign seal and heard him publish and declare this writing to be and contain his last will and testament and at the time thereof he was of sound disposing mind and memory and that he did it freely without compulsion to the best of our knowledge and belief.
