I James Leak of the County and State aforesaid being week in body but of sound mind and disposing memory, and calling to mind the uncertainty of life, and the certainty of death, and since God has blessed me with some property in this world, I will and dispose of it in the following manner namely - Item 1st I recommand(sp) my soul to God who gave it and my body to be decently buried at the discretion of my friends. Item 2 I give to my beloved wife Kiturah(?) Leak all my estate both real and personal after my just debts are paid during her life or widowhood for the support of her and my children that the said Kiturah has had by me, and their schooling expenses and residing privileges with my wife during her widowhood, but in case she should marry at that time I wish an equal division to take place among all my children that I have had by her the said Kiturah and herself equally and alike with the children. Item 3rd I give to my wife Kiturah and my children that I have had with her the two lots of land whereon I now reside also five Negroes namely Hannah, Allen, Robert, John and Nancy for the support of her and my children by said Kiturah during her widowhood. But in case she should marry I wish an equal division between her and her children by me. I wish my Executors to proceed as early as possible in settling all my just debts out of the property that can be best spared from the support of my wife and children. Lastly I do hereby constitute and appoint my wife Kiturah Leak and my son George W(?). Leak Executors of this my last will and testament. In witness thereof I have hereunto set my hand and seal this 4th day of October 1836. James Leak Richard S. Griffin James R. Jackson Matilda Griffin I James Leak add this codicil to my last will and testament. I have erased the name of Carlington Leak mentioned in my will as executor and inserted in lieu thereof my son George W. Leak as executor. I further bequeath a Negro woman by the name of Ann and her two children to my wife Kiturah Leak subject to be disposed of as the balance of my estate as specified in the foregoing will. Item 2nd I bequeath to my son George W. Leak three hundred dollars to be paid whenever it can be conveniently spared from my effects. Griffin do solemnly swear that I saw James Leak on the 4th day of October 1836 sign seal publish and declare the forgoing writing to be and contain his last will and testament and that I signed the same as a witness in the presence of the Testator that at the time thereof he was of sound disposing mind and memory and that he executed the same freely without compulsion so far as I know or believe and that I saw James R. Jackson and Matilda Griffin sign the same as witnesses to said will. Richard S. Griffin Sworn and subscribed in open court this 2nd Sept 1839 H.G. Johnson(?) C.C.O. Georgia Pike County I Kiturah Leak do solemnly swear that this writing contains the true last will and testament of the within named James Leak deceased so far as I know or believe and that I will well and truly execute the same by paying first the debts and then the legacies contained in said will as far as his goods and chattels will thereunto extend and the law charges me and that I will make a true and perfect inventory of all such goods and chattels so help me God.
